Can your I-29F application be denied if the petitioner becomes unemployed Please Advise?

Hi Everyone,

With the recession going on in the US I recently became unemployed and just like many americans who is trying to make ends meet. I am collecting Unemployement Insurance Benefits. Will this be the basis of my denial for petitioning my fiancee per I-134 affidavit of support? your experience, feed back advice is greatly appericated...

If, during the process, the USC becomes unemployed I think you will just need a co-sponsor for the interview stage. Good luck

If your unemployment benefits meet the 125% of the poverty limits you should be OK. You can always get a co-sponsor just in case.

Manila is historically pretty tough on the public charge issue. We don't have any reports of approval based on unemployment benefits. No matter how sympthetic I may be personally to your circumstances, personally, I can't see how a Consular officer can in good conscience, decide an intending immigrant will not become a public charge when their sponsor has nothing more than a temporary insurance benefit as income. If I were in your shoes, I would secure a close family member as a co-sponsor and do all in my power to become "employed" before the interview date.

Facts are cheap...knowing how to use them is precious...

I would agree with pushbrk. The I-134 is simply to give the Embassy an idea of the financial status of the petitioner and each Embasy handles it a little differently. As stated above, Manilla tends to be a bit more strict with this and with the ability to use a co-sponser. I too would find a close family member who meets the income guidelines (although any USC is supposed to be ok, Manilla tends to like people who have a vested interest in the couple). Also, have a visit to the PI Regional forum and ask those folks over there.

Unemployment IS income, but it is not permanent income. One could argue (and I bet YOU would) that no income is really permanent, but at least with an employer they can give you an employment letter, though less are doing that now. The have to protect themselves from parasitic attorneys.

I would strongly recommend you get a co-sponsor.

Even though your unemployment benefits may meet the minimum guidelines. I have yet to see a clearcut case where someone qualified on the basis of unemployment benefits. Seems to me, under certain conditions, a person could be approved. Particulalry if he had a long work history and presented 3 years of tax returns which demonstrate this is an unusual situation and likely temporary. The consulate COULD certainly approve you, even without a job, if they are convinced your fiancee will not be a public charge in the future based on past performance. You may even want to back it up with copies of any educational degrees, professional lisences or certifications, etc. Demonsrate it is a temprary situation and that you have bona fide occupational qualifications.

If anyone with VJ can give us examples of people who were qualified with unemployment, I sure would be interested.
