Hello guys... we submitted our application to remove conditional status back in December 2007 but have not received a decision - it's been 16 months.

We went to USCIS Newark to get the stamp on the passport to prove legal status. We got that... but no one there could tell us what is going on.

In January 2009, we received a fingerprint request for our son - 12 months after submission of application. Our son is only 5 years old so I don't think they'd need to do FBI background check on him. I think the delay was because they did not have our son's fingerprint. I hope it won't take another 12 months from January 2009.

Anyway, the officer there told us that my wife can apply for citizenship even if she doesn't have her permanent green card. The only problem with this is that it will further delay the green card process. Of course, if she gets the citizenship then they'll save money on not having to produce her green card, so they want the green card to wait for citizenship result.

Should I contact my senator? How do you do this?

CIS Ombudsman - Case Problems

When Should I Submit a Case Problem to CIS Ombudsman?

You should contact the CIS Ombudsman if you have an ongoing or immediate issue with USCIS, such as:

-You are facing, or are about to face, an immediate adverse action or impact, an emergency or any other type of significant hardship caused by an action/inaction/delay in processing by USCIS, or a problem, which could not be resolved through the normal processes provided for by USCIS;

-Your case experienced processing delays beyond anticipated processing times;

-You will incur, or are about to incur, significant and unusual costs (including fees for professional representation that are not normally incurred);

-Have not received a response or resolution within the anticipated time frames as published by USCIS.

7/2/2010 - Called mis-information line to put in a service request for STILL HAVEN'T RECEIVED "FP NOTICE"

7/8/2010 - LUD, at 2:32am, received text msg and e-mail for req. for add'l evidence being mailed out on July 6th, believe it's for the FP

7/12/2010 - Received FP notice in mail, scheduled for 8/2/2010

7/15/2010 - Walk in FP

7/22/2010 - Online status changed to "Case sent to local office for interview schedule"

7/27/2010 - Received interview letter for 8/23/2010

8/23/2010 - Passed interview, was informed that next oath date is 9/22/2010 and oath letter will come in the mail

9/3/2010 - Received oath letter in the mail for 9/22/2010

I am on the same boat with you, until now we are still waiting. I called USCIS but the woman said that there is no 60 days yet since USCIS received our RFE. I don't understand :angry:

Thank you very much jasminelily! I am going to file this and send it ASAP. You would think that they would contact me at least if there were problems. Or give me some kind of update as to what is going on with the case. I did not get any RFE's from USCIS. I got the NOA, bio appt for me, bio appt for my son, that's it. NO RFE.

I think (not sure) may be they've lost your file or the file is sitting somewhere to collect dust, if you don't do something, they're not going to do anything. So go with Ombudsman right away, if VSC couldn't find your file, then they will send you RFE after VSC is pushed by the Ombudsman. Good Luck!

We contacted our local congresswoman's office, we got a response from USCIS within about 3 weeks, granted it was an RFE but at least that means it wasn't gathering dust anymore....

I-751 Removal of Conditions

01/10/08 - Application sent to VSC

01/22/08 - Application Received

02/02/08 - Biometrics done

01/29/09 - I-551 stamped in passport at Tampa ofc

04/25/09 - RFE received

04/27/09 - RFE Sent back to VSC with additional documentation

05/11/09 - Approval notice received

05/18/09 - GreenCard arrived!!!

We contacted our local congresswoman's office, we got a response from USCIS within about 3 weeks, granted it was an RFE but at least that means it wasn't gathering dust anymore....

About 2 weeks after I got a letter from the Ombudsman, we got approved. Thanks guys!

I would not only file with the Ombudsman but your Senator(s) and Congressperson(s) as well. I would also make an InfoPass appointment. Basically I would leave no stone unturned. (Most Senators and State Reps say that they can help with immigration issues right on their websites. They'll make you sign a privacy waiver first, no biggie). You are well outside the "standard" processing times and I am outraged for you. Some people breeze through with their I-751's in a month and a half while others are kept waiting and anxious for well over a year. It's simply a lousy, broken system that needs fixing. Keep us posted.

Oh #######. I mean, yeah!!! I missed your second post that said you were approved. Feels great I'm sure. Time to celebrate.
