Newbie...need some K1 Advice

Hi...i'm new to this forum, and my fiance and I have decided to file for a K1 visa. he lives in England, but was born in Nigeria. Should he file from England. Also, when I send in the I-129F what documents needs to sent in along with my application? Any advice about the whole process would be gratly appreciated :blush:

12.22.2008 - NOA1 issued

04.08.2009 - NOA2 in 107 days - Igors List #174

04.14.2009 - NVC sent to Consulate in South Africa

04.29.2009 - Consulate received

05.04.2009 - Packet #3 received

05.08.2009 - Packet #4 received

05.14.2009 - Medical - Passed

06.22.2009 - Interview - APPROVED

06.29.2009 - Visa in hand

08.06.2009 - POE - Boston

08.22.2009 - Returned to South Africa

you can file in the country where he is a legal resident. So if he was just born in Nigeria but is a resident of the UK you can file in the UK.

We just followed the instruction sheet for the affidavit and turned everything in that is mentioned there...no problems. If you have any special questions ask those in details and you will get a lot of help and advice here.

US Entry : 2009-03-06

Marriage : 2009-04-16

AOS and EAD Timeline

2009-05-08: Sent AOS and EAD Application

2009-05-15: Check cashed

2009-05-15: NOA dated (both I-765 and I-485)

2009-05-18: NOAs received

2009-05-20: Touch I-765 and I-485

2009-05-21: Letter for biometrics appointment in mail

2009-05-22: Visit ASC for biometrics / Touch I-765 and I-485

2009-05-25: Touch I-765 and I-485

2009-06-05: original biometrics appointment

2009-06-26: EAD card production ordered (finally!!)

2009-07-02: Received EAD card in the mail

2009-07-09: Received Interview letter

2009-07-10: Requested reschedule of interview

2009-08-19: scheduled interview (didn't go)

2009-08-21: Denial letter reveived

2009-08-28: Discussion with local office. Reschedule request forwarded to officer

2009-09-05: Reschedule request denied

2009-09-11: Another discussion with local office. Endresult: Interview :) Medical information is missing

2009-09-14: Contacted Embassy in Frankfurt to request a copy of medical

2009-09-29: Recieved medical from Frankfurt and submited it to USCIS

2009-10-01: Green Card production ordered

Agreed about the residency part. I would definitely recommend filing in the UK over Nigeria if at all possible. Nigeria is one of the most difficult consulates and the UK is one of the easier ones.

Mailed AOS, EAD and AP Sept 11 '07

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

Unfortunatly, the UK can be just as difficult if you are from Nigeria, india, or any other difficult area. I think it is the region and not the embassy itself.

I agree with your assessment. But, I would tend to believe that the time he has been a legal resident of the UK would also have some bearing. IE.. If his parents moved there when he was a kid vs He just became a legal resident last year. This is ONLY my belief but, it would seem to make sense. Of course, dealing with the USCIS and other government agencies, common sense does not always play a factor!!!!
