K-1 visa application after B-2 Tourist visa denial

hi all..

im new here..i need help..

i have just applied for B-2 tourist visa and got denied. i was suppose to visit my boyfriend after his visit to me. but my visa application was rejected.

now, we decided to apply for the k-1 visa as we want to be together and this time, forever.

my worry is, will it affect the application if they saw my B-2 application was rejected then next day after the denial of visa, we submitted the k-1 visa application?

please all help us..

Many people did this and got their K1 visas. Just make sure you follow the instructions to the letter and have more than enough proof of seeing each other in the last 2 years and of having a bona fide relationship.

It won't affect your K1 application. I got denied for a tourist visa December 2007 and applied for K1 visa March 2008 and got APPROVED. As long as you are doing it right there will be no problem.Good luck!

It will not have any effect. My SO decided early in January this year to visit me first but had her B2 denied. So instead I went there to visit her and now I filled the I-129F the past week. Don't worry. Just follow the instructions and you will be ok.

January 25, 2010 - Cory received her SSN

March 9, 2010 - Received appointment for biometrics - will be on March 18

March 18, 2010 - Biometrics done

March 19, 2010 - Touches on I-485 and I-765

March 25, 2010 - Advance Parole approved..received on April 1 in the mail

March 29, 2010 - I-485 notice date, received on April 4, 2010

May 3, 2010 - EAD approved

May 5, 2010 - Date interview....approved

I had no problems getting my K1 after four B2 denials.

I-129F Sent: Aug 20th 2008

Interview Date: April 8th 2009, 10:30 - APPROVED!

K-1 Visa Received: April 9th 2009

POE: Aug 8th 2009, Minneapolis

Wedding: Aug 28th 2009

Our I-129f was approved in 114 days from our filing date.

Our case spent 52 days being chewed by NVC.

Our interview took 224 days from your I-129F NOA1 date.

Depends on the country (if it's in a high fraud status), age of the aplicant, level of income, job status, ties to the home country.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

She said it wasn't safe (it was an older lady, the interviewer). My take on it (confirmed by the employers of the same embassy, pretty much) is that I shouldn't have been so truthful during the interview(s). Last one was denied because I had a K1 pending.

Croatia is not a high fraud country and it is, normally, extremely easy to get visitor visas to the US. I had everything I 'needed', but it just didn't work out.

Yep - it's the call of the CO.

I saw a news program (60 mins or something) where they sent in a young women to get a visa. (very pretty, etc) and she was denied.

They sent her back, but made her to look "not so pretty" and they gave the visa to her.

Everything was the same, but her "looks".

Go figure.

I think you were given great advice here and most likely have nothing to worry about but it is still important to understand why the work/visitor visa was denied.

If it was simply because they believed you had intent (because of your SO0, or if you are dealing with a high fraud post that does not regularly grant visas that's one thing. But if it was denied because of deportation, previous overstay, crimes...etc. Then there will need to be waivers filed and hurdles to jump to get a K-1 issued.

As I said, you're mostly likely 'ok' but it's important others know all the facts.

He brought up the denials and said we should have outright applied for a K visa. For all the failed B2 attempts, I had invitation letters from either my fiance, or his closest family.

i was denied too because of that reason..visiting my boyfriend. My 2nd denial, i said i wanted to visit my aunt but the guy who interviewed me was the same guy who interviewed me the first time and i guess saw my previous application and the reason i was denied.

I got denied once. So he came down here instead of trying again.

The CO had practically made up her mind about denying before I even opened my mouth.

"Why do you want to visit the states?"

"To visit my boyfriend-"

*interrupt* "What does he work as?"

I had so much more to say but the fact that she had interrupted me at the first sentence pretty much gives it away. I wouldn't have had the nerve or heart to try 4 times. How long between each denial, by the way?

And as a frame of reference, she denied me because we had never met before and I didn't make enough at my job. Owning a house here didn't matter to her. My family here and ties here didn't matter.

I don't think Malaysia is a high fraud country either. Everyone told me I had been too truthful, blah.
