Well I am from Canada and I recently travelled to Hawaii for Pleasure purposes. My boyfriend popped the question to marry which we have discussed before, he is an American. We got married and soon learned there is alot to do with Immigration. I came to America and had to sign an I-94 which is a piece of paper tagged to your passport saying you are supposed to be out by a certain time, I was suppoesd to be out by March 15. I've decided to stay here though with him because we are married! The army knows we are married and everything is covered for me. Though I talked to Homland security and Immigration they said that aslong as I was in the process of paperwork I should be okay if it were to expire, obviously it's expired I'm still doing paperwork because it's a veryyyyyy long process. I just want to know can I be deported and is it okay to be abit expired because I know on the 1-130 it says state your I-94 expired or not? I don't see how most people who live here can't become expired because its a long process. Please somebody help me with direction! Currently were at the medical part and we will be sending everything in completed.

File your paperwork ASAP to freeze your status. Until you do that, you are considered out of status, and subject to deportation.

Once you get the NOA, you will be covered.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Well, right but this is the K3 visa forum and she's not removing conditions as her profile says and she doesn't need a K3 visa. This should be an Adjustment of Status case.
