I recently got married and filed for the AOS. My wife's dad is a joint sponsor along with her. One of the requirements for the AOS is your income tax return forms and W2s for the most recent tax year. Her dad was granted an extension for his 2005 taxes and has not yet filed them. If he submits his 2004 income tax returns and W2 along with his document from the gov't granting him the extension will that be alright or are we going to have to wait until he files his 2005 taxes?

Hey there.

I would say wait until you file the 2005 taxes. Our initial AOS application was submitted before the tax year, but one RFE slowed things down, and it wasn't until after the tax deadline that our case was reopened, and they then required the 2005 return.

You could always file it now with the 2004 return, to just get things moving which gives you time to get the 2005 return done, incase they issue an RFE.

06/08/2006 - Start job :)

06/10/2006 - Recieve EAD card.

07/02/2006 - Receive AOS interview date - 5th September

09/05/2006 - AOS Interview

09/07/2006 - AOS Approved. Email welcoming me to the US. Yey.

09/11/2006 - Receive the 'Welcome to the US Letter'. Green card is in the post etc.

09/18/2006 - Receive 2 year conditional green card.

Hi mim,

When your wife’s father filed a tax extension he filed documents that stated an estimated tax return for 2005 and he submitted a payment. You should submit the tax returns for 2004 and all the documents he filed for the 2005 along with the payment.
