I ready to just plain go crazy!!!! Need help and advice

well.... where to start

I been reading many different stories here at VJ. I thought my life was pretty plain and low key. I been divorced over 2 years after 16 years of marriage. Then I met Nadya online. From there no has had more of effect on my life than her. When I flew to Ukraine it was the most amazing 2 weeks in my life. That first time we actually saw each other was magnetic and passion rolled into one. I asked her to marry me during my stay and she said yes. !!! I talked to her every day. I never missed anyone as much as her. That's saying a lot for someone who has been married before. So we filed our K-1 in November. Here where my story starts to get crazy

I been to see Nadya 3 times in the last year. The last time I came back Customs asked me to go to secondary. Which I never gave a second thought about. So I give the officier my passport and he says have I ever had "trouble" in California. I tell him I never been in trouble Period!!! He would not tell me what my problem was. Even after asking I was left wondering what I could possible been mistaken for. I did live in California 12 years ago. I am a reservist in the Air National Guard and I went back in after 9-11 because I felt I needed to do something for my country. We have several Chicago cops in my unit. So I asked one of them to run I check on my name. He called me to tell me that my trouble in California has to do with I felony larceny arrest warrant. I was dumbfounded. I never done anything in my life ever close to this. I believe in the laws of this country. I raised my kids to honest hard working citizens. I always tried to lead by example. It is the reason I went back in the Air Force. One of the codes we live by is... Integrity. I just had security clearances done and this never came up. My friend says that This is so old and California knows where I am but will not come to get me. Illinios does not have an extritition with California so maybe thats why I never knew about it. I have had the occassional traffic stop for speeding. No one told me anything. This has devastated me to the core. So I come to find out that the last boss I had (who was a jerk ) reported me for stealing material. I worked for his father for 5 years and I mentored him as my apprentice. He asked me to work for his franchise. Well I was looking for a job so I want to work for him. Right from the beginng it was not good. I am a tradesman not a salesman. This company was driven by inflating bills any ways possible. I never made the money like some of the other guys did. I was getting very depressed. It was difficult but I found a job in Colorado but I had to be there in a week. My ex wife supported in this. She saw what was going on. So I packed up my family during the weekend. I parked my truck in the lot next to the office. I wrote a letter explaining my decision to quit. I tossed the keys in the truck and left. I had only contact after to get my w-2's and nothing was ever said to us about this crime. I never took anythng from him or his company. I gotten a hold of lawyer to begin the process to clear my name. This could take several months or years But you have no idea how much money this is running me. Well that's my story. Now I need to know what will this do to my application. Already my app is longer than most people with a similiar time frame. Can they deny the application? I know they can delay it. I have always been open about who I am and where I live. Being a reservist with a security clearance always require this. So folks I need some advice or someone with a story close to mine. Anything to keep from going crazy. Nadya know all about this and is very supportive. Yet I cannot help but feel this it really hurting her too. She hooked her heart to me and this happens. I love her very much and I need to be positive for her too. But tonight my heart is the lowest it has been. :crying:

When was your last security clearance? They're done every 10 years so thjis may not have showed up depending on when it was last done.

Anyway, obviously you know enough to have gotten a lawyer for your criminal woes but as far as the impact on the immigration process I'm not sure.

Perhaps you should seek more advice from an attorney that specializes in immigration law, or just sit back and see what happens.......

I read your post and I almost cried. This is heartbreaking. Im sure everything will go fine. If you didnt do anything then you should be fine. yes I would deffinatly ask the advice of an Immigration Lawyer. Alot of them do probono work, mine did mine free, every year florida lawyers i guess from what i heard have to do 2 cases free, i got lucky, and EVERYTHING i needed to know he told me. I would deffinatly seek the advice, a free consultation is free with most of them, and all your doing is asking a question. If you can not get one to give you an answer, I can ask mine if youd like me to.

I wish I had some advice or an experience to share with you but all I can say is that I hope everything works out for the best and that this happens as quickly as possible. I can't imagine how difficult it must be. It sounds like you're doing everything the right way though so hopefully this won't set you back too far. Good luck!

I can see you are devastated at the thought of this affecting your pending marriage.

I have no experience with this type of situation, and of course I'm no lawyer, but from reading VJ for over a year, the impression I get is that this shouldn't affect your petition. If your fiancee had been charged with a crime that would have an impact, but not you.

Consulting with a lawyer is a good idea; some lawyers will do a consultation for a token fee, but be careful of those who won't give you info without you agreeing to hire them. I came across 2 immigration lawyers, one consulted for an hour for $50 and another charged us $300 and said we could contact him for questions for quite a while. We came to VJ and didn't need him. However, he was quite prepared to charge me $5000 to complete the whole process to the bitter end of the AOS, and I must say, we're doing just fine without him, as well as not being in debt $5000.

Feb 28/08 - Biometrics letter received for The Bronx Office - have to reschedule

Mar 22/08 - Biometrics rescheduled - LOVE the Saturday appointment!

Regardless of the K1 situation I think the OP needs a Lawyer desperatly !!! Not that I like lawyers but it is the only way you are going to get this situation properly resolved. I would definitly want this warrant cleared up and off my record no matter what was going on in my life.

01/31/07 - Mailed AOS/EAD package for Olga and Anya

06/01/07 - Green card arrived in mail

Removing Conditions

03/02/09 - Mailed I-751 package (CSC)

03/06/09 - Check cashed

03/10/09 - Recieved Olga's NOA1

03/28/09 - Olga did biometrics

05/11/09 - Anya recieved NOA1 (took a call to USCIS to take care of it, oddly, they were helpful)
