Need some clarification on this....

Hi to all,

My fiance had his interview on Monday. He thought everything went well but was given a 221g because the CO said I had done the sponsorship papers wrong. He just sent me a copy of the 221g and it had these things checked:

1) Notarized affidavit of support form I-864 (circled)

2) IRS transcripts for 2007 and 2008

3) Awaiting results of adminstrative processing

Why are they asking for the I-864? I thought this was needed after the marriage when you apply for adjustment of status. I sent in the I-134 with supporting documents from me and my co-sponsor because I thought this was the form they needed. It even said to use the I-134 on his appointment letter!

What does administrative processing mean? Is there a problem with our case, other than them asking for the new sponsorship papers?

I need some clarification on this.

Affidavit of support is needed during USCIS stage and the consular/embassy stage as well as AOS.

Get these back to the embassy as soon as you possibly can, AP can take a while.

They gave him a date of June 4 to come back with the additional information. I am going to call them to see exactly what they want so that there are no problems when he goes back in (they do not accept mailings, he has to bring in the information on the specified date).

if they are asking for Notarized affidavit of support form I-864 then you should have your fiancee bring this filled out + a I-134 and let them choose which form they want...

Unsure why they would ask for that at this stage - especially since they say I-134 on the letter. (perhaps it is a standard checklist ?) - since they want tax transcripts for 07/08 - can you contact them for clarification?

AP means they are checking his background - usually standard for certain embassies.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Generally the I-864 is not notarized. Of course it could be, just as any document can be notarized. Strange they would ask, but OK, then that's what you have to do. Administrative Processing is something done by some consulates and means nothing in particular except you have to wait. In some cases it is a verification process of everything presented at the interview.

I cannot say if there is any other problem. Is this typical for this consulate? Check the consulate reviews and regional forums. If this is out of the norm. it would indicate something is amiss, or they suspect something is amiss.
