Hello all,

I just got a copy of the 221g that my fiance got at his interview Monday. We are applying for the K1 visa. So why would they request a notarized I-864? I thought this was to be submitted after the marriage when you are applying for adjustment of status. They also checked that we are in administrative processing. What does this mean? Is there a problem with our case? Would they have told him that? He just said that the person checked our evidence, asked a few questions (which he feels like he answered well) and then gave him the 221g, saying that I did the sponsorship papers wrong. Why are they asking for the I-864?

Also, he said that they did not make him take the oath to tell the truth and did not make him sign the forms that you are supposed to sign before the consular officer. I thought this was a required part of the interview. What gives?

He did say that there were two other people there applying for fiance visas, and they both were asked to bring in additional information at a second interview. So I guess they are not just picking on us, although I am confused about the I-864 and the administrative processing aspect.

Can anyone help me understand this?

Thanks :)

Hello all,

They should not be asking for the notarized I-864 because (1) it is used for AOS and (2) it does not need to be notarized  But, I have seen it being requested at some other consulates. Sometimes you just don't understand these people.

They also checked that we are in administrative processing. What does this mean? Is there a problem with our case? Would they have told him that? He just said that the person checked our evidence, asked a few questions (which he feels like he answered well) and then gave him the 221g, saying that I did the sponsorship papers wrong. Administrative processing is just the umbrella term for "we are putting your case on hold because we need more info from you". In some cases it can also mean prolonged name checks (doesn't seem to be your situation).

Also, he said that they did not make him take the oath to tell the truth and did not make him sign the forms that you are supposed to sign before the consular officer. I thought this was a required part of the interview. What gives?

I don't think you need to worry about that. Some of the forms are used for different kinds of visas so it may just be that they did not need that from him. Besides, its not like someone is going to tell him "You didn't take the oath, no visa for you!"

He did say that there were two other people there applying for fiance visas, and they both were asked to bring in additional information at a second interview. So I guess they are not just picking on us, although I am confused about the I-864 and the administrative processing aspect.

Its definitely become a trend in Accra for people to return for 2nd (and sometimes 3rd) interviews. This has been happening more consistently since June/July 2008.

I filled out the 1864 for the K-1 for my then SO which the consulate asked for. He didn't have an AOS interview and I don't know if that had anything to do with it being taken prior.

The longer it takes to introduce yourself the less you've actually accomplished

We had to come back with more financial information, but we were not asked for the I-864. We also went through this in 2005 though, so I'm sure things have changed.
