Trafic ticket in excess of $500 b/4 becoming GC holder

Hi Everybody,

I will be filling my N-400 soon (08/2009). But I do have an issue in my past before I got my initial GC in 11/2006. On 40/2006 Iwas cited by the police in Va for driving 98kmh on 65kmh road. The court later conficted and fined me about $1200. I paid the fine and the case was never reported to my home DMV for points on my driver licence. Thou, I did not declare it when i applied to remove the condition on my GC; which had been approved. Here are my questions:

1. Do I need to declare this offence since it occured prior to my becoming a GC HOLDER?

2. If iI declare it, what effect will it have on my N- 400 application?

The I-485 and I-751 both exclude traffic violations--so there was no need to provide them.

The N-400 does not exclude traffic violations--so you need to list them.

To answer your questions:

1. Yes you need to declare it

2. Probably no effect if you declare it. Huge effect if you don't declare it and they find it.

Side Note: I really doubt the speed limits were posted in kmph

1. You were cited and convicted, so yes. Just write an explanatory letter stating what you wrote here.

2. Almost certainly, none, unless you lie and are discovered. Moving-vehicle violations without damage or victims are not a concern. If it were, US Naturalization would only be open to those who never owned a car.

Well, I appreciate the prompts responce. Sorry, I meant 98mh on 65mh. Does the ackground check on N400 applicants include pr- GC stay in America (when one was leaving illegally in the country)? So, all offence prior to becoming legal ressident must be declared ( as in my own case)

any offense anywhere anytime. It's not limited to only offenses in the U.S. or since any particular time.
