Cenomar for me ??

Hi all, i am new to the fourms and have a question.

My fiancee in the philippines who i am going to marry next month over there in the philippines is saying that people are telling her that I also need go get a CENOMAR. but im 100% american born and raised. so why do i need cenomar ?

It is a requirement to fulfill the rules to get married in the PI, regardless of your 100% heritage, you need to follow the rules.

It is legal capacity to marry for you. You can get it from the US embassy just be sure to bring any divorce papers from previous marriages.

My husband is a USC(american) also and we got married in the philippines.We didnt get his cenomar, we went to the US embassy manila after his arrival to get his LEGAL CAPACITY TO MARRY coz his an american, this legal capacity is to prove that his single like my CENOMAR. It will just take a day to get this, you will swear to a consul and then show your passport and you will sign a documents that they will prepare.We paid a fee also, $30.00...

But i dont know now if they change their regulations, we got this NOV. 2007.Read this link....

Advice on this:

Get there early, I mean be in line before 8am. Have your passport, certified copies of divorce decree from any previous marriage(s) (you'll need this also for your PH Marriage License Application) and $30 US or 1,500Php (it was only 1,440Php in January but exchange rate varies).

When you get where you think you need to be, go a little further and get a Red Number off the wall to your right as you enter that last waiting room. This part will make more sense when you get there.

If you Fiancee wants to accompany you SHE MUST BRING OFFICIAL ID or they won't allow her to enter the embassy. My wife doesn't usually carry ID so she had to wait outside.

confused again with CENOMAR

CENOMAR- is a certificate of singleness (not required for foriegners who's marrying local pinoy)

based from what i've understood this is only intitle for K visas or non imigrat visas like K1 and it is only for local filipino born in the phils and he/she will comply this at National Statistics Office or NSO.

It would be helpful for us to know what type of visa you applied for and also :time:

If you applied for a K-1 visa, the USC does not need a CENOMAR.

Been there and done that. They open up the service line around 7:45. I was there around 7:15. Out by 8:15. And yes get that red number and listen for it to be called.

If you are planning of marrying her in the Philippines, you will need to get a Certificate of Legal Capacity to Contract Marriage from the USEm. Without this Certtificate, you two will not be allowed to get married or your marriage liscence will not be registered. For Filipino's we need the Certificte for No Marriage which can be requested from the National Statistics Office. These are to make sure that neither of you is still married and still has responsibility for that said marriage and therefore will not be allowed to marry anyone untill you are legally divorced or annulled with supporting documents.

sorry, i should have been more specific. i have been courting my fiancee RONA for about a year now. I am American and i do have my passport, certified divorce papers, and certified birth pt, also im going to get a rough draft of a g-325a from her. my plan is to marry her and petition for a K3 type visa. the reason i asked you all is cause people over there are telling her "its new" and that i need to get a cenomar. she already has her cenomar and birth cert from nso. also she mentioned she is getting her SSS id today. all this paper work is starting to sound kinda scary and i am pretty sure im going to pay Mr ray bacon for his services. as i have read good things about him.

can any one shed light on this cenomar ? and if they are just trying to confuse or ripp off my fiancee ? she may be naive to this. at first they were telling her i needed NSO birth cert AND cenomar but she found out elsewhere that only cenomar is needed for me.

i fly out in 8 days and am staying with her family for a month :) im excited and nervous all at the same time.

i love her so much I am feeling brave enough to do anything just to be with her.

im going to Lahug cebu, and as i understand it i can go to the water front hotel really early on week days and get my legal cap there from the american embassy branch. once i get the legal cap i should try in the same day to go get the marrige lic also ? im not sure about that but i know there is a 10 day waiting period.

thanks for all your help and i hope to get a time line going soon too

im going to take alot of pics and maybe even some video clips so they dont think im some scammer trying to get some fake marriages. i know they want so much proof its crazy.. so i scan our love letters and save receipts for all the XOOM money transfer i send to her.

I feel i may need to use my parents as co-sponsor also when the time comes

They are right and wrong.

Technically you need the CENOMAR but the US Embassy doesn't issue them so the PH Gov't accepts the "Affidavit of Legal Capacity to Marry" which is the document that the Embassy will issue.

What's the difference?

CENOMAR is an official Gov't document declaring that you are not currently Married "CERtification of NO MARriage". Since in the US Marriages vary from county to county the Federal government can't really issue such a document (No NSO).

The Affidavit of Legal Capacity to Marry is basically you swearing to the fact that you are currently Legally Capable of entering into a Marriage Contract.

So your requirement for a CENOMAR is ment by presenting the Affidavit of Legal Capacity to Marry along with divorce decree from any previous marriage(s).

I doubt it's changed since Jan 20, 2009.

Ok she is still saying i need a cenomar, they gave her some piece of paper and its on the list to get that one. i guess its NEW. so i guess i need cenomar. and my legal capicity

How to Get Married in the Philippines, If you Are a U.S. Citizen The U.S. Embassy in Manila, Philippines, states that the requirements for getting married in the Philippines, if you're a U.S. Citizen, are as follows:

1. Affidavit of Legal Capacity to Contract Marriage

Philippine law requires a citizen or subject of a foreign country to obtain a Certificate of legal Capacity to Contract Marriage, issued by the diplomatic or consular offices of his or her country, prior to the issuance of a marriage license in the Philippines.

As an American consular officers are specially prohibited from certifying that any U.S. citizen has the capacity to marry, the Philippine government has agreed to accept as substantial compliance with the Philippine law an Affidavit in Lieu of Legal Capacity to Contract Marriage ("affidavit"). The Affidavit attests to the absence of any legal impediment to the marriage and is sworn to before an American consular officer. Therefore, u.S. citizens wishing to marry in the Philippines must appear personally before a consular officer, either at the U.S. Embassy in Manila or the U.S. consulate in Cebu City and complete the Affidavit concerning their own capacity to marry. There is a $10.00 service fee, subject to change, for the notarial service.( NOTE: its $30.00 :) )

At the time a U.S. citizen appears to execute the Affidavit, he or she must present the following:

A. Proof of Citizenship. Examples of sufficient evidence of U.S. citizenship are (1) current registration as U.S. citizen at the Passport and Citizenship Office of the Embassy or at the Consulate, (2) a U.S. passport, (3) a birth certificate issued in the United States or a record of birth abroad issued by a U.S. Embassy or Consulate, together with identification bearing a picture or a physical description or (4) a Certificate of Naturalization.

B. Evidence of Termination of Previous Marriage (s). If the U.S. citizen has been previously married, evidence of termination of the previous marriage, such as a certified copy of the final decree of divorce or annulment, or a certified copy of the death certificate of the deceased spouse must be submitted.

C. Parent's Consent or Advice. Under Philippine law, the legal age for marriage is 18. If the contracting parties are between the ages of 18 and 21, they must present written consent to the marriage from their father, mother or legal guardian. Any contracting party between the age of 21 and 25 must present written parental advice, i.e., a written indication that the parents are aware of the couple's intent to marry.

Hi ryan! You don't need CENOMAR. Yes it is a requirement here in the Philippines if your going to apply for marriage license. But since you are purely US citizen, what you have to get is your Legal Capacity to Marry which you can get from the US Embassy in Manila. You get that from Monday to Friday 7:00 am to 10:00 am only. Just present your US passport. Your fiancee is the one who will apply for CENOMAR at the NSO not you.
