Hello All, :star:

My Husband is a US citizen who has filed I-130 & I-129F petitions on my behalf. As you can see from our signature, we just received the NOA2's for both the I-130 & I-129F yesterday.

Well, at this stage I am in a dilemma :unsure: as it seems that things are moving faster than we anticipated. I know this would not be a problem for most people, but I have some commitments forcing me to stay in India till end of September, 2009. I will also be able to do the visa interview only after that period as well. On the other hand, the NOA2 for the I-129F says that its valid only from 04/15/2009 to 08/14/2009.

I have the following queries (I appreciate anyone who attempts to answer) :

What does the term "valid upto" actually mean. I think they mean that my interview (for K-3) should be held within this period. Am I reading it right?

In case my interview (for K-3) must be held within valid period (04/15/2009 to 08/14/2009) then I would have to forego the K-3 because of the compulsion I mentioned.

In case I forego the K-3 and pin my hopes on I-130/CR-1 I am worried around how long it would take. Can anyone give me an estimate? Can I even make the choice to pursue only the I-130/CR1 and forget about the I-129F?

Also as I want the interview to be after mid september ...do you think I might get stuck with some validity issues with the I-130/CR-1 again.

Apr 20, 2009 - I-129F NOA 2 Hard Copy Arrived

may 28,2009 - received DS-3032

jun 29, 2009- dispatched DS-3032 to NVC

july 28,2009 - dispatched I-864

july 28,2009 - paid IV fee online

aug 10,2009 - received instruction package in email

NO removal condition

Citizenship

Oct. 2011-------- Filed N400

Jan. 2012 ------ Biometrics and Interviewed at same time

Jan. 17 2012 ---- Sworn In

I'm not sure about the specific rules in India. We weren't able to go to the interview before the I-129f petition expired. I wrote a letter to the consulate and they said it was fine. I think you can actually go up to 1 year. I would try to email or call the consulate.
