My fiancee filed for a petition for me in June last year. We got NOA2 after 3 mos only. I went to the U.S last March 23, 2009....since some things didnt work out for us then,

and financially too, he is not doing well, we decided I come home and wait for a better time for us to get married. I came home to the Philippines 2 days ago.. we both miss each other now and want to re apply for a K1 visa again sometime this year.. We have wasted money and made mistakes but are willing to try to work things out again..

Can anyone help us please and give us information as to what we are going to do as far as a re-application is concerned.... What do we need to do and submit to USCIS? Thank you so much. Any idea shared from anyone will be greatly appreciated..

You need to have a waiver for filing the second time around. USCIS wants it why it ended that way. You can start all over again. Hope it works well with you again .

Jan.6,2010- Mailed to South Dearborn Chicago via Fedex overnight delivery

Jan.7,2010- AOS packet received signed by Chyba

Jan.10,2010- Notice receipt from USCIS

Jan.13,2010- check has been cashed

Jan.14,2010- NOA1 received (hard copy)

Jan.23,2010- Biometrics Appt.received in the mail dated Jan.14,2010

Feb. 1, 2010- Biometrics appointment at 8a.m.

Feb.9,2010 - touched

March 2,2010- AP approved

March 9,2010- Hard copy received

March 12, 2010- I-485 receipt notice for interview

March 18,2010- received letter for initial interview

April 19, 2010- 8 :15 A.M INTERVIEW DATE ( APPROVED 5min.Interview)

APRIL 20, 2010- USCIS website updated card production ordered

IMBRA places two new restrictions on multiple K1 visas in cases where the petitioner has:

Filed two or more K-1 visa petitions at any time in the past, or

Previously had a K-1 visa petition approved within two years prior to the filing of the current petition.

A waiver may be obtained, however. Factors the USCIS will consider in evaluating the waiver application include, but are not limited to:

Whether unusual circumstances exist (e.g. death or incapacity of prior beneficiary(ies));

Whether the petitioner appears to have a history of domestic violence;

Whether it appears the petitioner has a pattern of filing multiple petitions for different beneficiaries at the same time, of filing and withdrawing petitions, or obtaining approvals of petitions every few years.

So, your petitioner will need to apply for a waiver to bring you back with another K-1 with the info you provided.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
