Since your first I-130 hasnt been approved/denied - this is a pending petition. I think in the situation you're in, its best to cancel this especially if your first relationship is over as this petition was filed by your ex.

K3 visa - also a pending petition until your AOS is approved and you receive a GC.

bottom line is, until you receive a GC , you are not a Permanent Resident. You have a conditional visa.

There is no law on how many I-130s can you file. I have asked this from many attornies, have done research on it a lot

did you bother to talk to NVC or USCIS? As far as I'm concerned, you have just created a big mess with your case by not cancelling your first I-130 and filed a 2nd petition.

Just like everyone is saying, divorce, cancel current petitions, go back to your country for a while and start all over again. I know immigration process is draining and long, but hey, the easy way is not necessarily the right way. Maybe you should just give up and do it the legal and proper way.

i know someone who camed in the us with a k3 visa, disn t stay married the time required and didn t even have a green card yet, she divorced him, and met someone else, they got married and she got her 10 years green card.

i suggest to talk to a laywer

been dating since june 1st 2007

dec-08 -officially engaged,i went back to France to apply for k1

2-11-09:noa1

3-06-09:My angel is visiting me

3-16-09:my angel is going back to the states

6-06-09: received NOA 2 HARDCOPY!!!!! ( notice date:-05-29-09)
