Hello all the members,

I just join the forum today and i'm not great of finding topic, if this were post in the wrong place i'm truely sorry.

Here is my questions, I would like to sponsor my parent to U.S but my Dad which is currently live with my mom right now is a step father. What would be the best way to approach this situation, if I filed the petition form for both would there be a delay process?? since my dad is a step father not logical, can you give a time frame should they be expecting if filed together. I'm not sure if USCIS even except the application for my step father to begin with since he is not a logical dad.

Please help any suggestion or advise would be greatly appriciated,

Yes you can file for a step-parent as long as their marriage to your parent took place before your 18th birthday. If that is the case then you have no worries filling.

You need to send a copy of your mothers divorce papers and her marriage certificate for the marriage to your step-father as well as your birth certificate.

It will take about 1 year from the time you file the I-130 to them getting their visa and coming to the USA.

It has speeded up a bit this last 3 months but I dont know if it will continue at the fast approval rate it has been.

I too filed for a step-father and so far have not had any issues.

Thank you for your promptly reply, since they're not married before my 18th birthday, I guess this will be a huge problem.

Sadly if they were not married before your 18th bithday all you can do is file for your Mother and then she would have to file for her husband once she has her Greencard, but the wait will be a long one as a visa would not be available to him for a few years They are currently issuing visa to spouses of greencard holders who filed in 2004. If she went on to become a USC she could have it upgraded and a visa would be available immidiatly but she would have to wait 5 years to become a citizen.

Yeah...that sound like a really sadly situation, I was reading up on it but could not clearly understand on the term in the instructions as I seeing something it read before the 18th birthday, but they worded so confusing. It nice to have such wonderfull forum and good helping peoples in here that help out many complicated issues that save on big $$$ on Lawyer fee, and on top of it all Imigration Laywers they all are A**hole.
