I-129 went to Vancouver/I-130 went to Montreal

Timeline

Hello everyone...

I'm at a loss here... all along I figured we would follow the CR-1 route and try to use the K-3 interview date at the end hoping the I-130 would get to the embassy by the appt. date. Now when getting our NVC numbers from the NVC operator I am finding out that our I-129 went to Vancouver and our I-130 went to Montreal... so obviously we cannot use the K-3 interview date now for the CR-1, (am I right?). So, someone with some experience please verify for me that we have to make a choice right now which route to go... correct?

We are now leaning toward the K-3 since we are tired of the wait. I understand that we will have to do the AOS when he gets here and can't work until we get EAD. What are the next steps in the K-3 process though... I'm lost since I've been thinking all along that we would do the CR-1. Can someone post a list of the steps for K-3. I was looking for a good timeline on someone's signature, but didn't find any.

04/14/2009 - NVC Received

04/15/2009 - NVC Left

04/17/2009 - Consulate Received

04/20/2009 - Packet 3 downloaded

04/23/2009 - Packet 3 Sent

04/23/2009 - Packet 4 Received (email w/appt. date)

05/20/2009 - Medical Exam - Vancouver

05/19/2009 - Interview In Vancouver for K-3 (Interview from hell)

05/20/2009 - Dropped off Medical at Consulate, No Visa- Told we are in AP

06/03/2009 - Email from Consulate-Visa mailed

06/05/2009 - Visa In hand

06/06/2009 - US POE, Winnipeg

EAD

06/14/2009: mailed I-765

06/24/2009: NOA1

07/06/2009: Recv'd Biometrics letter/appt. for 7/25

07/07/2009: walk in Biometrics early

08/04/2009: Card Production ordered!

08/10/2009: EAD card in hand!

NVC I-130

04-01-09: I-130 NOA2 (Approved) 155 days @ CSC

06/24/2009 : case complete at NVC

CR-1 Interview

11/25/2009: Interview at MONTREAL, CANADA (approved)

11/28/2009: Visa in hand (picked up from consulate)

12/14/2009: Permanent Residence Card in hand!

Employment at Wells Fargo Bank on Nov. 9, 2009

Done until lifting conditions... yeah!

This is correct, K-Visas can be interviewed for in either place however, Montreal is the only consulate that handles immigrant visas, K-Visas are Non-Immigrant.

You could interview for the K-3, and then interview for the CR-1later. You already paid the fees for the CR-1 to NVC ($470) if you do just the K-3 and adjust status you will be tossing the $470 paid to NVC and be paying another $1010 to adjust status and waiting MONTHS to get the green-card, it may be more cost effective to peruse the CR-1 through Montreal even with the added travel costs.

I just got our NVC #'s yesterday, so the I-130 hasnt actually gone to Montreal yet, but it will obviously after NVC processes it. If we decide to just go with the K-3 do you know where I can find a good list of step by step things that we need to do? And also, would we just not respond to the I-130 correspondence from here and just continue the K-3?

You would abandon the I-130 process and not respond to anything from Montreal, then use K-3 to enter the USA and then file I-485 to adjust status.

OR you can use the K-3 as it was originally intended, you can use it to visit USA and keep the CR-1 in process and then return to Canada (Montreal) and interview for the CR-1, THIS WILL get you a green-card FASTER and at much less cost than filing to adjust status from the K-3.

Keep in mind K-3 is NOT work authorized and cannot take a job until they adjust status and get green-card or perhaps EAD which can take 90 days or longer, CR-1 has the added benifit of being work authorized and gets a green-card upon entry.
