Regardless of what AWA says Everyone who is legally able to marry should have the human right to live together with their spouse.

Nothing in AWA says you can't legally marry someone, nor does it say you can't live together.

You just can't bring them to the US, to live together (immigrate), unless you get a waiver.

You are not prevented from moving to your spouses home country.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Well actually I am prevented from moving to her country permanently, I would be suprised if I could pass a background check to get a BI clearance for a visa , much less for residency. Being convicted of a crime of "moral terpitude" would according to Philippines Immigration law, make one a "undesirable alien" and ineligible for residency.

Makes me not want to risk applying for a visa past the automatic 21 days

For the record, Im not looking for sympathy ,I did the crime and the time, I accepted my sentence, howeve if all these laws would have been on the books at that time,my guitly plea would have never happened. Well, Im not gonna blog here , just trying to find my way through this immigration mess..

By the way if I could , I would love to live and work in the Philippines.
