When I was about 19 I had consensual sex with my girlfriend of 6 months, unaware that she was underage. She lives in Florida and I live in Alabama. Being that we had sex in both states I was charged as a sex offender in both states (Alabama its RAPE II consensual sex with a minor, in Florida its Lewd and lascivious acts with someone under 16) I served no jail time, 3 months adult bootcamp, 3 years probation 5 year suspended sentence.

I completed probation, and all the hoops that came with it.

Now I'm 27 almost 28 years old, I married my wife in the philippines (we are the same age) and she has no kids.

I have decided to go with an immigration lawyer whom I have confided in over the past year or so. , Please no negative comments, thanks, and wish me luck, as i wish all of you luck

Good luck with your application. Has your lawyer handled any immigration cases b4? What is he/she planning

on providing to USCIS?

Please don't disappear on us! You'll be able to provide valuable information to this forum. I do wish you the best in your journey. I'd be interested to hear whether you had any sex offender treatment. I highly doubt it since you'd not be using statements like "I had consensual sex with my girlfriend", if you were convicted of a sexual crime. No judgements here, just wondering how much you learned in treatment if you even had any.

Wish you good luck in this journey hope soon you can be with your wife,my advice just keep ur eyes open when u choose a lawyer sometiems they just take money and dont help too much....unfortunaletlly with this new law ,not even best lawyers can know what the answer will be just prepare the best evidences you can and keep ur hopes up.hope everything will work good for you and ur wife

If you did not know your "girl-friend of 6 months" age, that is one thing. But, today to imply a minor could consent to sexual activities is unacceptable and you should try to rephrase this part in your application. It shows little regret if you suggest that the ignorance of age was the cause for your two serious convinctions.

I have been on both sides of the fence. As a YOUNG child I was raped ( single digit age) by a 40 + year old man . That act was truely sick and desires more punishment than this world can dish out to him. I also have haev seen the affects from the son of my close friend ( who is 3 weeks younger than one of my sons ) being in prision for having sex as a teen with another teen. The sick thing is the teen/teen sex drew a longer sentence than the old fart/ child because of the difference in dates the events occurred.

I was explaining the charge let me make this ###### clear to everyone

IN THE STATE I LIVE IN CONSENSUAL SEX WITH A MINOR IS CALLED RAPE II , I didn't label it consensual sex with a minor my state did, if you dont like how they describe it you might want to contact my state rep and explain to them that you have a problem with how my state names laws

I refuse to let this thread be a discussion about what is right or wrong or your opinions , this about immigration and my case if you dont like it, dont follow it, dont post here.

to the OP: please keep us posted on your journey as it may benefit others in similar or same positions. However, please note that this is a public forum and if you post comments about your personal life, you do open yourself up to comments in return. Saying that you didn't know how old your girlfriend of 6 months was (yet you were traveling across state lines and having sex) will undoubtedly open yourself up to comments. The poster who commented on rephrasing that part of the application referring to consensual sex was not passing judgment, it seems, but rather offering you advice on how to better word your application.

I mean no disrespect, but if you can't handle comments which may be negative in nature, then don't post personal information on a public forum.
