when does the CR1 expire?

I was just wondering if some one knows the answer to this question. My file is in DHS hell and I have no idea when it will ever surface. So lets say that I have to resubmit the whole application again. When does it expire so I can begin the process again without the useless expensive lawyer. Thanks

Married August 21 2004 in Nova Scotia!

October 19/04 sent I-130.

April 17/08 finally arrive back in New Orleans after 3 years and 8 months.

May 19/08 Perm Resident Card arrives.

July 24/08 Reapply for a new SS card with married name.

August 4/08 Baby daughter born.

Not sure what you mean but the CR1 is i bleive valid for 6 months after being issued so i assume if your visa has been issued then you have 6 months before you can resubmit an application. Not sure if this is what you mean but i figured i would try and help.

23rd February 2005 Married.

10th May 2005 I130 packet sent to TEXAS forwarded to Cali.

12th May 2005 NOA1 Received date.

14th May 2005 delivered at 4:34 am LAGUNA NIGUEL, CA 92607.

23rd May 2005 NOA1 notice date.

27th May 2005 NOA1 hits the mailbox.

13th August 2005 po po form mailed off with £10 cheque.

2nd September 2005 po po letter arrives.

3rd September a 4 week visit to GA assuming i get allowed in.

30th september 130 days on I130 and counting.

(Hopefully i finally get a wedding ring today too)

30th November NOA2 date. woohoo

January 2006 case arrives at NVC finally(not sure about exact date)

17th February 2006 IV bill mailed back

21st April case complete (sorry i have missed some dates of forms going back and forth)

2nd May case forwarded to Embassy in London

10th July 2006 visa interview 10.30 a.m.

Like yabasta I'm not sure what you're asking. You don't have your visa yet, so what is your concern about it expiring?

Meanwhile, your I-130 petition has been approved and is at the NVC, so what is the "DHS hell" you mention?

Yes, my CR1 application has been approved. BUT my visa has been denied because the consulate is researching all my previous TN visas, when I worked in the states. Therefore, my question is, although my CR1 was approved, but I have no visa so how long is the application(CR1 paperwork that I filed in Texas) valid for?

With an approved application I was under the impression that that paperwork alone was valid for 1 year from the time it got approved at the processing center and sent to the National Visa Center. So is the approved application good for a year, two, less than that. That's what I'm asking and need to know.

Yodrak-DHS hell means that the Department of Homeland Security is now responsible for researching 6 years of my one year TN visas. I call it hell because I can't get a straight answer on how long it's going to take them to go throught them all and get back with an approval on my visa.

You still seem to be confused - your CR1 immigrant visa application has not been approved. You say so yourself, in between saying that it has been approved.

I understand your reference to the DHS now. I don't disagree that it's hell for you, but the fact of the matter is that the DHS can't tell you how long their investigation is going to take because they don't know the answer and won't know until they've finished the job.

I think the OP is saying that the I-130 for the Cr1 was approved by USCIS then the Cr1 denied at the CO. At least that is my take on it by looking at the timeline.

New Orleans bound, Sorry to hear of the long wait. It sounds like a nightmare. I don't think the I-130 will expire while your case is being investigated.

I didn't realize I was that confusing Yodrak. I was refering to all my application as the CR1 and I should have probably separated it out. My inital paper has been approved, meaning The I-130 application. The application is separte from the visa CR1. It's the application the the consulate needs in oder to grant one a visa, therefore I have an approved applcation but no visa.

And Joej thanks for answering my question. What I understand is that while the DHS is still reviewing my application, it remains valid. Meaning I don't need to resubmit another I-130 to Texas again Untill a decision has been reached.

You have an approved petition, which qualifies you to submit a visa application.

You have a visa application that is pending while an issue that is material to your case is in DHS purgatory.

You are correct. I have an approved petition. And that's all I have. I was really worried that I'd have to resubmit all the paperwork again if that petiton expired. Seeing that there's not a lot of people in my shoes, I posted to get answers. I tried editing my post but I seem to get kicked out of that function, I didn't mean to sound bitchy. I guess it all comes down to presentation.
