Help... very confused

I'am not only confused.. but very irrate at what's going on with my case. Well to give you a little background on my story. I filed my 1-751 back in March 2008. I did my FP in April and receieve my notice NOA at the end of March 2008. Now my actual notice stated that my case was sent to the VSC. I called customer service numerous times to inquire about my case and all they kept telling me was to wait at least a year,b/c that's how long it was taking them to process it. Well.. in the last past year, I have checked the website religiously looking for any case or processing time updates. Finally last week the VSC uodated their website and my case has now fallen outside of their normall processing time. I called last week to set up an inquiry through customer service and got that going; however, I still had a gut feeling that something wasnt right. SO i called today agian... and come to find out i actually got to speck to an USCIS Officer... who advised me my case was never at the VSC and had been at the TSC all along!. I was SOOO FURIOUS AND CONFUSED b/c in the last 6 times i have called, customer service has never told me my case was at the Texas center. My notice also even states at the bottom that it was sent to the Vermont Center. But what makes me even more furious is that if this officer is actually telling the truth my case is WAAAAYY out of the processing time,b/c TSC processing time is 6months. That means i could've put my inquiry about my case MONTHS AGO!!!.

has anyone ever heard of this being the case...??? i don't know what to think. I Need so advice

The officer also said that b/c my receipt number started with the letters SRC and i live in FL.. that means my case correponds at the Texas center.

Congressman time - go the their local office with all your documents and have the immigration specialist do something for you, you can also ask some questions from your congressman (he will forward to USCIS don't worry) on why so long, how come it was sent to TX when it should be the other center - not likely you will get an answer but will definitely draw attention to your case and get a speedy approval.

You could even do INFOPASS as well as apply for N-400 if you want to naturalize.

Yeah thanks, I'm in the process of contacting my congressman and senator. I'm faxing them the letter tommorrow... but from what they told me over the phone today all their going to do is see where in the process my case is. I dont know how much they can really help???.

I'm SOOO tired of waiting!!!

Use the Ombudsman option if no result from congressman or senator.

7/8/2010 - LUD, at 2:32am, received text msg and e-mail for req. for add'l evidence being mailed out on July 6th, believe it's for the FP

7/12/2010 - Received FP notice in mail, scheduled for 8/2/2010

7/15/2010 - Walk in FP

7/22/2010 - Online status changed to "Case sent to local office for interview schedule"

7/27/2010 - Received interview letter for 8/23/2010

8/23/2010 - Passed interview, was informed that next oath date is 9/22/2010 and oath letter will come in the mail

9/3/2010 - Received oath letter in the mail for 9/22/2010

What you were told doesn't make any sense. It sounds more like the mis-information from one of the call center people than from an actual immigration officer.

There are NO removal of conditions applications being processed in Texas let alone any at 6 months. There haven't been any for quite some time. The 'official' date was last Spring sometime - I don't remember if it was May or June, but TSC transferred all of the submitted I-751s to VSC at that time and USCIS published an official announcement that TSC and NSC were no longer processing I-751s and that such applications were now to be sent directly to VSC and CSC. That is why what you were told makes absolutely no sense. I would definitely contact your Senator - they can help you. When my I-751 file was approaching a year I contacted them and 3 days later had my approval.

Good luck in getting this sorted out. I am inclined to think that you still haven't talked to a real Immigration officer but one of the Call Center misinformation people, maybe even one pretending to be an USCIS officer - the information you got is so totally incorrect that I can't believe a real immigration official told you that.

From reading on Kathryn41's reply here, also talked to one of my old friends that I haven't seen in a while today, she has this experience that took her a year and a half. She said they lost her file, I asked her how. She said her file was left at TSC and didn't get transferred to VSC. So is it possible that your file also was got left over at TSC and didn't get transferred to VSC? Good thing for her is she complained a lot, then applied for naturalization, and finally they found the file, she is going to oath ceremony tomorrow. Hope things would work out for you, good luck!

Unless the file was never shipped or misplaced....possible, yes?

You may qualify for a true expedite under USCIS error.

Why would an immigration officer tell him TSC is processing I-751s in 6 months when they are no longer processing them at all? And, if he saw it was at TSC and not transferred - in spite of receiving the notice of transfer - why hasn't it been transferred now? Why would an immigration officer say it was still at TSC if it was indeed 'lost' unless they knew it was there - or weren't telling the truth? Still a lot of unanswered questions.

I agree that the OP has every reason to be very, very, very annoyed. I hope your Congressman/Senator gets things sorted out for you asap.

If it was indeed left behind at TSC, then yes, you should definitely demand an expedite based on USCIS error.

Why would an immigration officer tell him TSC is processing I-751s in 6 months when they are no longer processing them at all? And, if he saw it was at TSC and not transferred - in spite of receiving the notice of transfer - why hasn't it been transferred now? Notices are computer generated. It's possible that TSC generated the notice and said that the file will be/was transferred to VSC but in fact it didn't get transferred and VSC didn't verify that they've received the file or thought they've received the file. When the IO talked to the OP, the IO found out what a big mistake they've made and was just trying cover his/her own butt.

Doesn't matter how many questions, definitely need to be expedited and apologized!

A little off topic, sorry to the OP, but this also makes me wonder how many VSC transfers to CSC would got left over at VSC this time around. Good thing is that VSC is still processing I-751, not like TSC that had completely stopped. Good Luck to everyone!

Yeah thats the same thing I was thinking... all the information sounded werid coming from a real immigration officer. The thing that has me confused is that you guys say the TSC stopped processing 1-751's back in the spring some time. Spring is around the same time I submitted my application. WELL! on another note... I sent the letter to the congressman and i also did the immirgration ombudsman ... the suspense is killing.. i cant wait to hear a reply!!! I also have my info pass appt next week..I'm just so upset thought!.. it's not fair that i have to got throught all this hurdles just to get my GC!

Nope! Definitely not fair, just like why weren't we born in US but have to immigrate here, life's never fair, everyone wish they're millionaire. Stay on this board long enough, you will find out you're not the only one that USCIS ever messed up with. USCIS hasn't done anything too bad to me yet, but you bet my counter-measure would be very drastic if someone wants to mess with me. In life, and in dealing with government agency, you've gotta fight/work hard for what you want and the secret is squeaky wheels always get grease first. So better make some noises about the unfairness, otherwise no one would even bother to take a glance at your case until you apply for citizenship. Best of Luck!
