Hey guys. So I'm looking to do this process instead of the K3 and have some questions. Does being denied a tourist visa in the past and overstaying a past visa by a day or two(including travel time) make us ineligible for this? My future wife has been denied a tourist visa twice in the last year. First time she was told she didn't have enough ties to her country and the second time they told her she should finish school before applying(her Masters). Also she was here in the summer of 2007 on a work and travel visa for 3 months. She overstayed by 2 days including 1 day of travel time. She wasn't told anything was wrong when she left but I'm just wondering if any of these issues would make us ineligible for this visa. Thanks.

I don't think with the info you posted that it would prevent your K-3.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

A denial of a tourist visa(s) won't affect your petition nor will the 1 day overstay.

You should be fine

April 29, 2013 - NOA1 for petition received

September 10, 2013 Interview - decision could not be made.

April 15, 2014 APPROVED. Wait for oath ceremony

Waited...

September 29, 2015 - sent letter to senator.

October 16, 2015 - US Citizen
