Hello, I am currently on a F-1 visa (OPT), filing my I-485, I-130, 1-765 and I-131 all together.

I read the checklist, and have a couple of questions...

1. Would it be ok to file I-485, I-765 and I-131 together with one ACCO fastener? Or should I make a separate package for I-765? I thought I should prepare two packages (one for I-130, the other one for I-485, I-765 and I-131) using two ACCO fasteners, but I saw some people filed three packages.

2. As my husband (US citizen) was a student until summer 2007, his income exceeded the poverty line for the first time last year. I see many people sending tax returns, W-2s, 1099s for the past 3 years, but in our case, I am not sure if we should send his 2006 and 2007 tax returns because he didn't make enough income back then. Would it better to send them anyway?

3. Should I make a copy of all my I-20s (I have three I-20s issued by the same school), all visas I had (I used to have J-1) and all entry stamps on my passport? I am wondering if the latest one is enough.

This is exactly the situation that my wife and I were in. (I'm the citizen, we have completed AOS.)

1. I would separate the three forms, they are not necessarily processed in the same place.

2. I would only send the last year. The instructions say "If you believe additionalr eturns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years." I would not send them, they won't help. I would send a letter from your husband's employer stating 2009 salary and the expectation that he will continue to be employed, if that is possible.

3. Yes, you should send copies of all the I-20s, of all the Visas, and of the DS-2019 for the J-1, (this is important because of the possible 2-year home residency issue). All of this is relevant to your total immigration "picture."

1. I am adjusting from F1 as well but I sent all in same package and I think my case has been proceeded pretty fast.

2. I sent only the last year's, then brought this year's tax return to the interview, which was today.

3. I am not sure but I would send all of them. I was asked if I have stayed with other visa at the interview, and I had L2 visa before F1, so no papers for that visa now but just answered verbally.

We used Acco fasteners to file our AOS. When the lawyers filed my husband's O1 visa they used Acco fasteners as well. I hope it doesn't slow the process down too much.

We had the 130 in one packet and the 485 (that included the 131 and 765) in another. Each were in their own manila envelope. We then placed both packages in a bigger envelope to be mailed with a cover letter for the package.

I lost my DS-2019, but hopefully I will be ok...I know I am not subject to 2-year home residency.

buttahgurl, thanks for the link!! I read about ACCO fasteners here in the Assembly Tips, so I was just about to go get some tomorrow.
