Hello,

I wanted to get some information from those of you who have went through the process in Canada to immigrate to USA. My fiancee and I are marrying on July 4 in California, he will be going back to BC until we have the ok for him to move here. My question is what has worked the best for those of you in Canada, the I-130 or the K-3? If we do the K-3 he can do all in Vancouver but then we have to pay the extra $1010 for adustment, if we stick with the I-130 he must interview in Montreal which is about $800 for flight. We would love to hear from any of you and your experiences. Thank you.

The I-130 is just an application to apply for a visa, so really you are talking about the K3 vs the CR1.

The CR1 is the better visa for many reasons, it's cheaper and will enable your Husband to work right away, virtually.

each visa has its + and - and it is different for each person! I belive---and it may have changed that a k3 going through Vancouver may be a bit faster than a k3 that has to go through Montreal! a k3 going through Mtl is around the same time frame as a CR-1! Cr-1 is probably the least hassle of all the visas and maybe the less $$$$ But read the guides!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

The I-130 is just an application to apply for a visa, so really you are talking about the K3 vs the CR1.

The CR1 is the better visa for many reasons, it's cheaper and will enable your Husband to work right away, virtually.

Actually, the I-130 is the petition that the US citizen must submit to be approved to sponsor their foreign spouse. The visa application comes after the petition approval, and there are a few Department of State forms required for that.

For the K3, the USC has to submit both the I-130 and an I-129F petition, which will lead to a K3 visa application. Or skip the K3 altogether, just submit the I-130 alone, and go for the CR1 visa application.

My vote would be for the CR1, even with the travel to Montreal, it works out cheaper.

I'm a little unsure of your current situation right now though, unless I'm reading it wrong. You married July 4th in California and your husband is still with you and hasn't returned to BC? Or you ARE getting married this July? Sorry, I just had a hard time understanding the circumstances.

Another option, if he's just visiting now, and had no intention of marrying upon his arrival to see you, would be to marry now and adjust status while he's here as well. Move up the wedding and start the process now if this is the case. It's all about intent. If he didn't intend to come to visit and you getting married was a spur of the moment decision, then you can adjust his status after marriage while he's visiting.

If you can get back to us, we can better advise about those possibilities.

We were told that if he applied for AOS after marriage that he could be sent back to Canada, penalized and not be allowed in the USA for up to 2 years. We don't want to take any chances. It sounds as if the CR1 is the best way to go even with travel to Montreal but everyone seems to have a different take on the CR1 and K3. I have gotten answers that say K3 is much faster and better way to go and others say CR1 is faster than K3 and better. Right now I am really confused!! Just want to do things the right way so we don't get into any trouble or penalized or denied! If going the K3 route and paying some extra to do the AOS that is fine if the K3 will be faster than the CR1. My only advice is, don't let customs know he's going to be getting married on a specific trip. They're paranoid, and they may think he's going to stay permanently. They could stop him, and really put a damper on any and all wedding plans. o_o BRING PROOF OF STRONG TIES TO CANADA and always, be honest..

We were married last July and I returned to Canada in January to persue the CR-1 - it is the most economical and most practical. We could have shaved about 1.5 months off of our time listed line below by paying all fees on line, and not being held up at NVC for an extra week. Please see my time line for an estimate of time.

Okay, that's for the clarification! So, ignore my comments about getting married and him staying to adjust status. I thought he was maybe down there right now.

It's all about time and money on what you want to do at this time. Money up front, money later...and when he wants to work once arriving in the US. That will probably be the deciding factor.

I would strongly recommend that you pursure the CR1, the K3 has turned into a nightmare for those of us who have venture into that black hole. It seems like USCIS does not have any intrest in honoring the K3 application process. The CR1's are now being processed at a faster rate than the K3's at both service centers.
