Okay to Work Now??

Timeline

We got a notification for my husband that "a new card had been ordered" for the EAD on the USCIS website and please allow 30 days to receive it. Does that mean it has been approved and is on its way? He came here on a K-1 on December 31st, married on January 23rd and filed February 15th and we are still waiting. We have received the Advanced Parole but not the EAD.

You may want to check for yourself, but I believe Nik's approval notices clearly stated that they were not sufficient evidence of the real thing.

So, I believe that means that an EAD approval notice does not count the same as the EAD itself. Also, I believe the I-9 specifies that the work authorization must have a photo. The good news is that the card should be in your hands next week!

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

Yeah your right. I believe the only time an approval notice is worth anything is if you already had EAD and you've gotten a notice that it will be renewed.

No, a receipt is only valid if you have lost your EAD.

If you are awaiting your first EAD, or a renewal of EAD, the receipt is NOT sufficient to prove work authorization.

No, a receipt is only valid if you have lost your EAD.

If you are awaiting your first EAD, or a renewal of EAD, the receipt is NOT sufficient to prove work authorization.

Yep your right from 90 days or when the EAD expires, which ever comes first.

We got a notification on April 27th stating that the EAD card had been ordered. Then on May 11th, we got the same notification and then today we got a notification that the EAD had been approved. We STILL do not have the EAD in hand. I am not sure what this means. Has anyone had this happen to them?

Yes there are always three notices. They really mean this: #1 we approved the EAD, #2 we made the card, #3 we mailed the card to you.
