hello....just a quick question from a friend..

my friend got their approval yesterday already but later found out that there is a missing form for her child (who is 9 years old)..i think the husband forgot to file the I-130 for the child...

i am not really familiar with her situation..can you give us an advice?

What kinda of visa do they want for the mother and her child?

Service Center : Vermont Service Center

Consulate : Bangkok, Thailand

Marriage : 2006-11-08

I-130 Sent : 2008-02-22

I-130 NOA1 : 2008-03-10

I-129F Sent : 2008-04-08

I-129F NOA1 : 2008-04-14

I-129F touched: 2008-05-06

I-130 touched: 2008-05-09

I-129F approved 2008-09-05

I-130 approved 2008-09-05

NVC received 2008-09-12

Pay I-864 2008-10-08

Pay IV bill 2008-10-08

Done for 3 years or 10 years. Haven't decided yet.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

i believe they file for k3...

Have them file ASAP. The child can get the K4 visa without filing the I-130 but will need I-130 approval when they adjust status in the US later.

If it's for the CR-2 then and it's been awhile since filing for the mother then there may be problems "marrying up" with the childs and moms petition.

Worth trying tho as the CR-1/ CR-2s are MUCH MUCH better visas tham K3/K4

if you file for K-3 for your wife, you file K-4 for the child.

THis is the easiest way as no forms need to be filled out, you just need to have the kids name on the forms already files. You just add the child to the P-3 retun packet andhavet ot have the necessary documents.

If you filed cr-1 for your wife, the child comes on, I beleive cr-2 and you must have already filed the I-130.

If you did k-3/k-4, you file the I-130 after the child comes to the US.

I am in this k-3/k-4 quagmire now.
