Good morning everyone,

My name is Natalie. I am an African American woman. On June 19, 2009, I am leaving to be with my fiance Ifeanyi in Nigeria. My duration will be short because I have to return back to work. I will return to the United States on July 5. We both would like to get married in June through the registry. My question is will my Ifeanyi be able to return back to the United States? Also for our case, what is the best petition to fill out, the K-1 petition of the K-3 petition?

No he will not be able to come back with you . It takes about a year for a normal petition to be approved and for the interview to take place in Lagos. If the interview goes well he will be able to come at that time If you marry while there you can not use a K1 which is for unmarried couples . You will file a Cr1 and have the option of a K3 in addition to the K1.

arghhh Just realized I said a K3 in addititon to K1make that in addition to the CR1 I definately needed more coffee this morning . Coming back right after getting married is a common rumor in Nigeria. If you apply for K1 you have to have met him face to face in the last 2 years. If this is going to be your first trip then you don't qualify yet. You say you are going to marry in June ? If you tavel on the 19th you probably don't have time to to the premarriage stuff. One thing in Nigeria is you don't want to take any shot cuts. Everything in Nigeria can be speeded up for a price but it will cause more issues with the embassy

RFE returned April 17th,04

RFE received April 21,04 at NSC online

NOA2 received April 29th,04 via online

NOA2 received May 03,04 in mail

NVC receives file May 6th,04

NVC sends file to Nigeria May 11th,04

Lagos receives our file, notified thru e-mail May 19th,04

Victor goes and picks up packet #3....May 20th,04

Sent request for earlier interview date via e-mail May 20th,04

May 27th, Lagos won't change date.

August 16th, 2004 fly to Nigeria for Victors interview

August 19th, 2004 Interview date, visa approved.

August 25th, 2004 Victor picks up passport with visa stamp.

August 26th, 2004 fly back to USA

September 18th, 2004 Victor arrives in USA, Lord willing.

October 9th, 2004, we become husband and wife

October 25th, 2004 I learn that I'm pregnant.

Feburary 25th, 2005 AOS Appointment

( went to appt. and requested a reschedule)

June 7th, 05 gave birth to a boy child.

July 5th, 05 Victor packs he suitcase and leaves for good.

July 2005 2nd AOS appointment

( went and requested a reschedule )

August 2005- I file for divorce. and withdraw immigration paperwork.

Welcome Natalie. You've found the right place to help with your journey. Lot's of nice people, and good information.

As already mentioned, you will not be able to bring your soon to be husband back on your return to the USA. FYI ... as an option (in my personal opinion) I think the K-1 Fiance Visa option is faster. Just my opinion, so please be sure to research what's best for you.

If I were you, I would not get married and file a k-1. your spouse arrives typically faster than a k-3. My opinion, but compare the two timelines. Any further questions PM me.

AOS TIMELINE

Mar. 30, 2009: AOS/EAD/AP filled

April 7, 2009 - EAD,AP and AOS NOA notice date

April 10, 2009 - received NOA1 hardcopy for EAD,AP and AOS

April 13, 2009- received Biometrics appt scheduled April 25, 2009

April 14, 2009-Biometrics walk-in done!

April 14, 2009-Called USCIS for AP to be expedited.

April 16, 2009-AP approved YES!!

April 24, 2009-EAD Card Received!!

I don't think she intended to imply that Washington cared what his tribe is from. I understood it to be more of a personal/ cultural/ getting to know you question.
