◦Form I-130, Petition for Alien Relative (if you are filing for both parents, you must file a separate petition for each parent)

◦A copy of your birth certificate showing your name and your mother’s name

◦If your name or your mother’s name is different now than at the time of your birth, you must provide evidence of the legal name change.

◦If you were not born in the United States, a copy of either

■your Certificate of Naturalization or Citizenship or

■your U.S. passport

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

The best thing to do i think is to read the I-130 instructions form. I think it is very clear and concise. I am currently filing for my mother and now at the waiting for the embassy interview phase (NVC), by using the document below, I went through, relatively quickly compared to others. Also if youre Jamaican, USCIS no longer accepts the old version of your birth certificate( the new version is computer generated as opposed to hand written). if you dont have the latest version then you have to file for one ( had to get that out there :-) )

I just saw your signature and realised youve been through the process before. So you should have the experience of filing for someone.. all you have to do is send the same documents as before minus the marriage related stuff...

I do not think your mother birth certificate and passport require copy require to submit to USCIS but no harm to send it. Eventually you need your mother birth certificate (original and photocopy) and passport photocopy for NVC procedure. In addition, you need to submit your original marriage certificate to NVC, if married.

For USCIS:

I-130

G-325A from petitioner and beneficiary

Your birth certificate showing your name and your mother's name

Your marriage certificate reflecting name change (if applicable)

One Photograph for the Petitioner and one photograph for the Beneficiary (Mother)

Copy of the Petitioner's passport (U.S. passport) or Naturalization certificate

Your mother will get an IR5 visa, also follow the guide for CR1/IR1 it is the same process.
