Is K3 even worth doing anymore?

Hi,

we are getting ready to apply for the I-130 visa to bring my wife to the US from the philippines. All the research and feedback I have been getting so far is that that K3 visa isn't really worth doing anymore because it takes as long now as the I-130 or longer to get approved.

Is this true and is there any benefit to filing both. I also, was told that some people have had problems/delays becauise they filed both.

I cant see any problem in filing I-130. As soon as you get the receipt from I-130 then thats the time you have to file for I-129F with no cost. It will only take 3 months after that. I went thru that process. If you gonna wait for the I-130 to get approved, it will take you 1-2 years. Visit uscis.gov for instructions. Goodluck!

This answer is about two years out of date. K3 is all but obsolete an has been since November, 2006. Some people just don't know it yet.

Facts are cheap...knowing how to use them is precious...

This just when you want to be with your spouse soon. You have a point there about the CR1, thats if you are willing to wait. Think about it. Applying for SSN is not that hard, you can process your green card while you are already with your spouse here. I dont believe about that no need to wait to wok, US will not give you work automatically, hehe.

THE WAIT TIME IS ALMOST THE SAME NOW. WITHIN A MONTH OR TWO. MY WIFE ARRIVED HERE NOV26, 2008. SHE HAD ALL DOCUMENTS TO WORK WITHIN A MONTH.......

Have you check out the many K3 filers from last Nov. and Dec. who are still waiting for approval? That is a bit more then 3 months of waiting time then the above statement. Filing for K3 is useless now, esepcially if your going to be at VSC , waiting nightmare. Stick with I-130 USCIS processing time per their website is 6 months.

Your information is way out of date, check my signature below. I-130 was approved in 24 days from mailing, it took 16 days to be assigned a Case # at NVC and we are now well on our way to getting a interview in June/July.

It does not take years.

K3 is taking just as long if not longer and you would then have to file for AOS at a additional cost of $1010.00

Again, your answer is a couple years out of date. CR1 no longer takes longer than K3. Things started changing in that regard in November 2006. Please read before posting.

Quite frankly I wish the USCIS would abandon this K3 nonsense for not only does it confuse people but is more costly, bureaucratic, and is essentially a rip off. To have this system still in place which in no way fulfills its original intention and is grossly unfair to all those who go this route.

People have been led into thinking that by going the K3 route they will be re united with their spouse quicker. I can personally verify that this is not the case. I cannot even imagine the added cost to the thousands of immigrants who pursue the K3 route and if immigration attorneys are taken into account as well even more expense.

I implore all VJ married couples to pursue the CR 1 IR 1 route wherever possible and lets kill off this joke of a petition process.

I do not know to whom to address this reply. In my opinion, either K-3 should be abandant or make it faster. Not only VSC take long time to approve but it also US embassy/ consulate take long time to issue interview date/visa. Many times, there is disadvantage for applying K-3 over CR1/IR1 visa.

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Come back and tell us how much time you saved and if it was worth the hassle or the extra money. You have a very fast timeline every step of the way, so far. Frankly, I'm surprised the I-129F managed to get married up with the I-130 with that fast of an I-130 approval. So far, I'd a call it a fluke but things do seem to be changing fast.
