? on I-485 and how to Extend K3 Visa

Timeline

My husband came over on a K3- visa

My question on the I-485 (AOS) is on Part 2, Which one would I check?

Now my 2nd question is how would my husband extend his visa if needed because he wants to visit his family next March?

Any help is appreciated.

if he gets his greencard then their is no reason to need a visa anymore

On Part 2 on the I-485 check box A

And if you get the AOS applications completed in a timely manner, then you shouldn't need an extension of the K3. When does his K3 expire? Have he been here a year already and you're just getting around to AOS now?

My husbands K3 expires Sept 30, 2009 and Yes we are just getting to mailing them off now because we/I had alot of things that had to be taken care of first.

I am actually in this same situation. We applied for the Green card last September, plenty of time, I thought, before his K3 expires which is 2nd May 2009.

Now we have had our interview and they have asked for some information that will probably take some time to get, and more than likely it will be AFTER 2nd May 2009.

I have found on the internet that possibly there is a "period of stay authorized by the Attorney General" for 30 days between the k3 expiring and if you have already applied for the adjustment of status, but have not received a decision.

I can't find anything on the USCIS site about this and would hate to ring up to ask as I know I would get a different answer every time if I did.

Anyone have some difinitive info on this?

If AOS is currently pending, then you shouldn't need an application to extend the K3. Only the EAD I think, if he intends to work.

If AOS has not yet been submitted by the time K3 expires then extension will be required.

The form to extend is at th USCIS website Application To Extend/Change Nonimmigrant Status and the fee is $300
