Missing Original Divorce Decree... AOS interview

Hello Friends!

My husband and I have our AOS interview Monday. We have plenty of evidence of our joint life together, pictures, bills, etc. We also have every piece of paperwork sent to, or received from USCIS, with one exception. We can't find the ORIGINAL divorce decree from my husband's first divorce. We found the original and notarized translation of the divorce decree, but no original. We have been very diligent about keeping all of our paperwork in one place, so I'm wondering if we might have turned in the original somewhere in the process. My question, then, i s twofold....

1. Does anyone in a K-1 process with a spouse who has had a previous marriage recall if the original divorce decree would have been turned in during a normal process (we have had no RFEs or anything, just followed the "normal" visajourney up to this point.)

2. If we likely did NOT turn it in and have lost it. (ugh), does anyone have any experience or advice about whether this document will be crucial for our interview? As I said, we have a copy (because it's in our K-1 packet, of which we have a perfect copy) and we have the original notarized translation, but no original.

Any advice on this matter would be greatly appreciated.

as a clarification... I wrote "first divorce" and meant "first marriage." My husband was married (and divorced) one time before our marriage. (This is his second marriage and my first.)

I don't think it will be a big issue, since you made it through the processing for the K-1 to this point.

Just take your copies you have with you to the interview.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Divorce decree is not required for the AOS stage (based on your having gone through the K1 process already) - bring what you have to the interview but its doubtful it will come up. :thumbs:

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

IO might ask to see it during the interview, but you have the notarized copy of the divorce decree.

So I don't see any problem because the notarized copy has got same value as original anyway.

We have the original and notarized translation. (When the paid translator translated the divorce decree, it was notarized and signed) We do not have the original divorce decree, which is in Spanish. We don't have notarized copies. Just the copies, and the original copy of the translation, which was done in the US>

Trying to Remember if we were asked for my husbands he had 2 previous marriages ). However I would say do not sweat it, but in the mean time get the original from Colombia just in case.

A copy of the divorce decree was submitted with his I-129f or he would not have gotten the I-129f approved. Copies are generally OK but the USCIS can ask for originals at any time. You can get an "original" from the court clerk where the divorce took place. Not before Monday though. You will either have to change the appointment (not recommended) or bring a copy. You may have to re-submit the original.

I don't think you need the divorce papers. Our lawyer didnt ask for it when she filed our AOS. You will be fine ..just bring your notarized copy just in case. GOOD LUCK!!!

Congrats! Glad you didn't need it. Sorry you had a panic attack though wondering at that late stage whether you need it. Phew! (F)
