I posted this on the CR 1 forum but thought i'd post it here as it applies more to this forum.....

Any help or advice greatly appreciated.

My wife is a US citizen who is legal and lives with me in the UK. Yesterday we filled an i-130 for me to move to the US as she's really not happy in the UK. As she has the right to live and work in the UK we have filled in London which helps us avoid the dreaded NVC in the US. I have a couple of quick questions that i hope you good people will be able to help me out with.

1) How long does it normally take for the whole process to be sorted out?

2) This is the one i really dont know about. My wife works here in the UK at McDonalds and we are going to use her parents as a joint sponsor to really give the income a chance. How on earth do we put that on the i-864??? We will go and live with her parents whilst we sort ourselves out so do we take the poverty line as a household of 4 which includes my wife and I, or just as 2 which is what it is currently with her parents?? Any help with what to put on the AOS would be greatly appreciated. I honestly dont know how to put down her income as the form is all in dollars and also confused about the household size.

3) How stressful is the visa interview in London? I'm hoping it will be easier as we've already gone through the USA - UK visa process which shows its a proper marriage.

Read the guides and example forms here on VJ to learn about the process. Also reading the form instructions will answer many of your questions.

Your wife must file a I-864 as primary sponsor regardless of income level. Her parent(s) will fill out a form as well. Your wife is not being sponsored so she is not included on the parents' form. If there are no other persons in the parents' household then it would be a household size of three (mother, father, immigrant).

Convert her income from pounds to dollars.

The DCF process in London generally takes 4-6 months, but I see that they have been approving I-130s quite quickly recently, so this may be a touch faster now. The interview is pretty low-key -- I attended with my husband, and they asked him when and where we met, where we were going to live in the US, and what he was going to do for work. That was it.

I would recommend that your wife start compiling documents to prove that she has either maintained or is re-establishing domicile in the US. This would be things like bank statements from a US bank, a US driver's licence, any proof that she's still tied to the US. London will ask to see this at the interview, so be prepared. Even a letter spelling out the steps she is taking to re-establish domicile can help. London is fairly laid-back about this, but there have been a few incidents when someone was given a slightly harder time about it.
