We was planning for a marriage here in the USA with in 2 weeks of my fiancee ariving, the reason is her mother might be coming and she can only stay 2 weeks.

Well, then I notice a problem... Social Security Card... Texas requires a SS card/number to get a marriage license here, which it seems you have to wait 2 weeks to apply for (so it will be in the system) and another 2 weeks for it to arive. Hmm.. anyone else deal with this situation, have any tips for a solution? I cant afford to go out of state for a wedding, the wedding is going to be simple as it is already.. whew.

Ok, if there is a county close that doesnt require the ss#.. can I get the license there and then get married at my home county? Or is it required i get the license int he county that im getting married in? (haha maybe this is a really noobie question, it feels like it.)

Not a problem for two reasons

1. When your fiancee arrives, drive from the airport to the SS office. Apply for the SSN using her passport, K-1 visa and I-94. If they give you ANY problems ask for a supervisor and DO NOT leave until you get someone that understands K-1s may apply for a SSN immediately on arrival IN HER MAIDEN NAME. You will have your SS number the next day (if you call them and ask) and the SS card withikn a week. The problems and delays ooccur when you try to do a name change and/or run into untrained government clerks who prefer to make new law, rather than ask questions. DON'T change the name. Do that later. After AOS change her name with SS. Apply for the AOS in her married name (if she will change it ) You may need to educate the people at the SS office, so go to the Soical Security website and printout rules and requirements for SS cards as applies to K-1 visas.

2. The Supreme Court rules last year in the case of a Tennesee county that a state canno require a SSN in order to issue a marriage license. If you need to educate the county clerk about that, you can look it up in court decisions.

My wife arrived on Thursday afternoon. SS was closed. We were there when they opened Friday morning and she had her card on the next Wednesday, 6 days after she arrived.

Call the County Court office. We got married in Arkansas, what we read said I needed SSN but when we called them they told us I could just bring my UK passport.

Yes, but you can go to any SS office to get a card.

The best thing for you to do, as you leave one phase of this process, and enter another, is to educate yourself on the laws and regulations which will govern your life for many years to come. Uneducated and untrained government clerks are NOT the authorities on your life.

Go to the SS website, get the information you need and bring it with you to the SS office. Too many people take the SS card too lightly and allow themselves to be denied because of a clerk. The SSN is valuable for many things before your fiance starts to work, he needs it, you need hi to have it. Do not allow anyone to deny what he is entitled to.

So you think its no issue, that I would be able to go ahead with the plans for marriage in 2 weeks of arival?

Other option would have been that my fiancee come here first, and once we get orginized her mother follow. I really didnt want it to happen that way because they would both have to travel alone here to the USA.

Guess I will just have to pray and hope for the best and continue with the plans for the 2 weeks.

Also, check the SSN guide found on the Guides page. They do suggest you wait 2 weeks after entry to let the system update before you apply for SSN.

I also agree with talking directly to the county clerk and explain the situation. She will have tons of paperwork from this visa process so something should be useable.

I would double check with different counties. Minnesota law also requires a Social Security Number. I called an immigration attorney about this and he told me only one county in Minnesota had been enforcing this and they stopped when threatened with a law suit. I also checked Dallas County in Texas and nothing on their site says anything about needing a social security number. I pulled up the online marriage license on their site and there is no place on the form to enter a social security number. Check with other counties close to you. My guess is you can find one that will not require a social security number.

Texas does not require a Social Security number to get a marriage license. We got a marriage license the day after Nick arrived in Texas. There is a 3 day (actually 72 hour) waiting period between getting the license and getting married so plan ahead.

Our county website listed SSN for obtaining a license, so I called the county clerks office and explained he was foreign and wouldn't be able to have one. (We married the 5th day.) She said, all he needs to bring is his passport for photo id. She said if the person has a SSN (like me) they are required to give the number when applying.

So call up the County Clerks office at your courthouse and speak to somebody knowledgeable from the marriage license department and ask them to verify that is their policy.
