AOS Without NOA2?

Oh I also made sure to reference any of my ldn numbers a# and WAC# at several points in the letter. Plus referenced my maiden name. Perhaps it was overkill but I have lost trust in them being able to use commen sence.

Thank you Hannah for sharing all of these steps and experiences. There is still a couple of weeks before we will send our AOS, bus it seems like we go through the same story as You.

Well its been a month this Saturday gone since my Noa1 date for my three appliations, and more than 2 months since the service request for non delivery of the noa2 from our k1 petition.

So far I still have not received my biometrics appointment yet I have no idea if this is related to the lack of presence of the noa2 in my packet, though i feel probably not, in all honesty i have a feeling they struggle to remember to notify me of things and that this is just my bad luck.

So i phoned yesterday about the biometrics appointment and a service request has been sent and it has a due by date (when it should be sorted by)of 19th August. still no sign of a result on the service request for missing noa2. but its over the amount of time stated so we can call about that now too. thought i would update what little i have for those following what is happening to me in case any of it is relevant.

Thanks Krikit, I actually got a really nice polite and efficient person on the phone yesterday and i am really suprised and impressed, she just did what what needed without the bad advice or telling me i'm needing to wait rubbish, just instantly got the service request generated and gave me a ref number and date. just sad it seems to be i am not getting the important letters i need from them. i get other stuiff from them like noa1s and things and we haven't moved, so its not miss layed in the post. I am thoroughly convinced that for some reason, things have not been sent to me and this would be the second time, just my stupid luck i guess Just hope that things speed up a little now and go a bit smoother. just hope they dont forget to send me my greencard when (touch wood) it gets approved.

Biometrics notice was generated on the 22 nd and I got it in hand yesterday. Unfortunatly my appointment is for 19 th of... August sheesh my ead and ap are estimated to be adjudicated in the first few weeks of august acorrding to vj estimates so I would assume waiting will hold them up and I can kiss good by to that date.. Thrrefore I am gunna push my luck a little and try and go early and do a walk in. Hopefully they let me do it. Fingers crossed just wanted to update for those following my story.

OK This is well daft, got the service request letter through for the missing biometrics today informing me that until its completed my cases are on hold. also informing me their records show that i was sent a biometrics notice already (was i?)and that they have included a copy of the notice with the letter. it goes on to say that if my appointment has gone by already, how to request a new one where to phone or write and also how to change address.

thing is its the same notice as the one i got on Saturday so i checked the dates

18th of June is my NOA1 dates for aos ead and ap....

Monday the 20th july i phoned up and got a service request for non delivery of my biometrics as it had been more than 30 days since noa1s

Wednesday 22nd July is date on the biometrics letter (both of them) when it generated ...I was assuming this was due to the service request. the date of the appointment is 19th of august on both appointment notices. first one came on Saturday the 25th

However the service request letter was generated friday july the 24th..arrived today.

did someone cover their backside and send out a appointment before responding to the service request? possibly....or maybe its was only set because of the service request...I don't know. i just wish my appointment was closer...will have to try a walk in...but i find the dates of these things just wacko.

Ok I have some big news on my case!! :dance: not quite THE big news but its extremely close!

Yesterday my lovely Husband brought up the post and there was a letter from uscis for me!

bearing in mind i have not had a touch on ap since the 23rd of June, and 31st of July (day after i completed my biometrics) on ead and aos.

I have had no emails or updates or changes of status/transfer notices on my cases online. its still says received and pending and that they are at the national benefits center on all three on my cases. (What a surprise )

So guess what this was? I HAVE AN INTERVIEW FOR ADJUSTMENT OF STATUS!! :dance: its on the 9th of sept (our 5 month anni )at a very early time of the morning,

Now we have to prepare all our documents. I haven't had an rfe for the missing noa2 yet. Do you think that means they won't be turning around at the interview and demanding it? they still have not resolved or contacted us again on the service request hubby got for said missing noa2 hardcopy. I am not sure if we can get them to sort it out before Sept 09th.

Oh well i am so excited the end of this part of the journey may be in sight. just hope its not too much more bumpy fingers crossed

I got an update yesterday on ead and ap online, but no change on aos online so that still says at NBC recirved and pending .

Aparently on the 10th ( same day my interview letter arrived) card production was ordered on my ead and ap! Yay!!

so Wednesday the 13th i got a wierd second email about card production ordered on ead with the 13th on it as date. and the status has been updated to match odd.

Friday Hubby phoned to check on the status of service request for missing noa2 and i was hopping to have big news for you but i just checked and i was disappointed.

Hubby chose the options to report problem with case and then report missing document or non delivery or whatever it says.

got through to an officer (female) who understood what our problem was and could see the problem as she saw the other case (aos) at the NBC

she told him a new service request would not get done it time for my interview which she could see was set for early sept.

she told Vito to fax proof which was a copy of k1 papers and nvc letter to a number she gave him for the attention of officer...(her anme) and she maybe able to update the case to approved on the computer herself today (yesterday) but she needed to see the proofs before she could do so. she said she would be there till 4 30 pm that day.

So we did at just after noon. hoping and really thinking we had got some progress. we didnt phone up to check she got it again and i wish we had but we had such a busey day we were not finished again with appointments till after 4.45pm our time (LA).

I Just checked on line (today)and we had a new touch from yesterday, on the case but no change in status. so bummed bout that.

but after we got home later yesterday I found my ap in the mail yay so all in all its been a good week, almost an excellent and banging week but turned out to be a really good one instead. still waiting for ead to be delivered and hoping to get some good news or progress on noa2 eventually.

i was chatting with Vito and he said that the lady actually said hopefully by Tuesday if i can do it. So there is still hope of getting this NOA2 before the interview

Thanks krikit we finally got a copy of noa2 in the mail yesterday! The nice lady last Friday came through for us! Now we can proove we have an approved petition.

Our NOA2 was lost in the mail as well. There is something fishy with these cases.

Following the posts on this thread, we called USCIS and started an

investigation. When we first called, our I-130 case was listed as

pending as of July 2009. Later, we received a letter on our case saying

we had been approved on April 6, 2009! Yes, months earlier. When I checked

the online at uscis.gov, our case had been "MAGICALLY" updated to say

that an approval letter had been mailed to us on April 6. So yes, somebody is

covering their tracks.

We called USCIS on the phone, and they even suggested that we try

and write a letter explaining that the NOA2 was lost in the mail.

We sent in our AOS forms with a cover letter explaining our situation,

and giving investigation numbers. We also printed out the webpage

showing that our case number had been approved.

In the end, we followed kirkit's(?) advice and the uscis operator's advice.

IT WAS DENIED.

The rejection notice I-797C says:

"Your application packages was submitted with a single remittance and one

or more of the applications/petitions were unacceptable in the package for

the reason(s) specified on the related Notice(s) of Action (Form I-797).

Please correct the flawed application(s)/petition(s), and resubmit the application

package with the appropriate fees and supporting documents to the address

listed on the bottom of this notice."

I set up an INFOPASS appointment to ask some questions.

It seems ridiculous to me that we should have to pay 340$

for an approval form, when THEIR SYSTEM already says that

we are approved. If the INFOPASS appointment doesn't go

well (which I suspect it will not go well), then I will consider

getting a lawyer. It seems illegal (maybe extortion) to make

us pay for a form they already have!

I will keep everybody on VJ informed about my INFOPASS appointment.

Ohmygosh, jpiz.... that's just horrible. I hope your InfoPass appointment goes well. I'd be screaming for a supervisor if it didn't.
