If so, just ignore them. If I were in your shoes I'd do what Krikit did. :thumbs:

Yes but we got transfered up a level they are also apparently launching an investigation but it will take two months. We are going to do what krit krit did. But we wanted a date to reference that we tried

Can you tell me what did Krit do? I called USCIS today and, as expected, they asked me throw $400 to get a duplicate which I am not gonna do.

I am wondering at what point of time does the paper copy of NOA2 come into use? I am a USC and I filed the I130 application for my mom. She is in China at the moment.

well i haven't done the i-130 so i am not entirely familiar with how it works but i can tell you that with the k1 visa i have, we need to adjust my status from the k1 visa to get a greencard and it seems that they want us to send a copy of our noa2 with the forms for adjustment of status package as proof of petition approval. though i havent actually got uscis to confirm this yet. they adviced us to do the i-130 purley because they thought we were lying about having been approved already. which is what our problem is. we didnt need to show them the noa2 before now because they internally sent one to the nvc and embassy after the approval.

I think you are already in US and want to adjust your status and they want you to show NOA2 as a proof...

In my situation, my mom is still in her own country and she won't come until I finish everything (DS230 etc), so I donno if she will still have a AOS interview or not when she gets here. I assume if she doesn't have AOS interview then NOA2 will not come into use anymore.

It is so annoying! Why do we need to worry about the mistakes that they are making!

Just set up an infopass apt...no need for a SR number...I went today to my first infopass and I can tell you that it 's the best experience i've had with USCIS so far :) She saved me $500 :)

the second person on the phone on fiday who was ment to be a level up told us that infopass was basicaly the same as talking to him. grrr wish we could have done info pass because then i could have shown them the visa and tehy would have stopped accusing us of lying (effectively).

i just feel so angry i am reading the instructions for i-485 and is see where thy as for noa2. but they ask for copy of noa2 marriage licence and i-94

WHAT ABOUT THE FREEKING VISA IN THE PASSPORT NOT A BLOODY MENTION.!!!!

They do ask for a copy of the visa with the I-485.

i guess i forgot that bit sorry but in the detailed bit about k1 visa they don't list it again just noa2 i-94 and marriage cert. I am just feeling really frustraited and nervous and it makes me angry.

we want to do it but the book and correct but because some muppet didnt feel like doing what they are paid to do and checking for a human error on their part they want to cost us time. they couldnt give two hoots at what the results would be, bet it hasn't even crossed their minds that mistakes on their part could separate genuine familys. i mean look at the post of the poor guy who was denied his wifes removal of conditions because quote they would have denied it anyhow and because they lost the file. :angry: i mean they are playing with peoples lives . so why can't they just make some effort to correct their own mistakes? sorry rant over i feel better now i got that out :blush:

Timeline

So I called the USCIS to tell them I never received the NOA2 and the online system showed my I-129F petition as still pending. The lady also said the system showed my status as pending (even though the NVC already sent me their letter and my fiancee had received her packet). She said someone would look into it and I'd get the NOA2 by June 2.

Today, in the mail I get a letter from the USCIS. Nope, not the NOA2. Instead they send me a letter saying they mailed out the NOA2 on March 26 (which is clearly a lie; the system didn't update to this until after I called them). It says if I want a copy I need to fill out the I-824 (and pay $340). In my job I've often had to deal with the government, and the USCIS is by far the worst.

Ok it just gets more rediculas. We are definstly not waiting two months for them to send us that letter. We will file aos as soon as we have my vaccinations ready

I fully sympathize with you.......

It seems like my Fiance and I are having a similar problem. Our on-line case status says:received and pending, we got NVC letter, all packages from the embassy and I already have a K-1 visa and I am about to depart to the US. The USCIS information line keeps giving us contradictory information about our approval notice, including the one that our case has not been approved yet. At the same time, we would like to be sure that we have all necessary documents to file AOS once we get married in couple of weeks. Calling the info line seems pointless and do not know if we can schedule an infopass appointment. What have You both finally decided, have You filed the AOS without NOA2, including an explanation note instead and if yes, how to compose such a note?

I would appreciate all comments and experiences shared,

We phoned them one last time which finally resulted in a service request for non delivery of approval notice which resulted in a letter but we have not had the conclusion yet and were quoted 2 months to investigate so we went ahead and took kritkits example on post 15 I think of this thread and submitted a explanation letter requesting all our efforts to get the noa2 and why and what we have submitted in leu of it and to please accept those. With it we sent copies of the noa1, NVC letter, and service request letter, we tried to outline our efforts with dates Or as close as possible. In the letter. It was accepted on the 18th of June ( noa1 for aos) I have yet to even get my biometrics appointment through so we do not know if it will work or not yet. Fingers crosses it does if they request noa2 in rfe I am hoping the service request is complete and we can at least order it. :s

if you read through this thread kritkit was quite helpful as theyhad almost same problem though online they had been updated correctly. She helped me in deciding how to writethe letter.

Oh and because I didn't trust them to read through the package after reading the letter I reiterated that I had also included a copy of k1 visa and marriage certificate as per usual protocall.

As I said still waiting to see if it works. :(

Oh I also made sure to reference any of my ldn numbers a# and WAC# at several points in the letter. Plus referenced my maiden name. Perhaps it was overkill but I have lost trust in them being able to use commen sence. :(
