The embassy asked for the marriage certificate, proof that my fiancee is single, in the packet 3 and 4 provided by the US embassy in Rio. We provided a (non) marriage certificate with the original application, but it is over a year old now, (it wasn't at the time we sent it in). Do they require another certificate?

They also asked for a police certificate and birth certificate. All were provided in the original application. I know the police certificates are only valid for a year and we need new ones, but do we need a new birth certificate and a new marriage certificate too? Are they just asking to bring the original certificates that were already submitted or are they asking for new ones?

The marriage certificate is nearly $300 in Rio. I'm not sure about the birth certificate. I guess another $300 isn't that big of a deal on top of everything else.

A K1 visa applicant better NOT be able to produce a valid marriage certificate. Perhaps you could provide the direct reference to or quote the request to which you are attempting to respond. Perhaps there's a context problem here.

A certificate of Non-marriage. A certificate stating that she is NOT married, proof that she is single. I thought I made that clear in the original post, sorry if it was unclear.

They want proof that she is not currently married.

If a certificate of no marriage or single status is required then yes, it must be dated within a year of the interview, preferably as near the interview as practical.

No, she hasn't been married before. If it's only valid for one year, then she's going to have to go get another certificate. This is completely ridiculous. They make you do all the paperwork twice because they can't seem to process quickly enough. If it was good enough for Homeland Security, the embassy in Rio ought to defer to their judgment.

I'm really irritated with this whole procedure. I'm sure it will probably get worse once she is here trying to get a greencard.

Sadly, the embassies and consulates are part of the Department of State, which has an uneasy relationship with Homeland Security regarding the handling of visas (a whole other story, not for here). Yes, the consulates are irritating and 99.44% unchallengeable; just thank high heaven that you're dealing with Rio and NOT Guayaquil, which is deeper than the lowest level of Dante's Inferno. Once we pried the visa from there, I felt a sense of relief that we'd again be dealing with USCIS, which speaks volumes.

My wife just got approved for her first green card. I am actually far less angry now with USCIS than I was during the K-1 petition procedure, because AOS/EAD/AP approval occurred very uneventfully and in fair time. Perhaps when your wife's time comes for those filings, you'll have a similarly non-negative experience. Meanwhile, keep the faith, si man.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

What is it called? We have an interview on May 7 and I haven't read anything about this...Where did you get it?

no they do not make you do it twice... it appears you submitted information with your petition that was not requried

i just googled and found this "A Certificate of Single hood or Record of No Marriage certified by Itamaraty"

To me, all that stuff is for getting married in Brazil. I have no idea why the consulate would want it since it isn't in their list of things you need. It'd be nice if the OP would give more detail. Did he register as her fiance in Brazil, did they use that as proof, etc.

No, I've submitted everything in the US, in California, through my Lawyer. It was required as part of the documentation sent with the i-129F form, as were the police certificates.

I emailed the embassy in Brazil and they confirmed, we have to get all new documents because the others are too old.

Now we're having another issue with the vaccinations too, it never ends.

Even if we got married in Brazil, I would still have to wait FOREVER to get her here, meanwhile I can go get a $130 five year unlimited visa to Brazil in a week's time with one form. My country irritates me.

Also, I have been to Guayaquil, that place is a ####### hole. My friend got into a taxi, with one of our local business partners (a native), then three guys with guns got into the taxi, drove them around to ATMs, then took them 3 hours outside the city, dropped them off, and took their shoes. Nobody got hurt, but I'm sure it ruined their night.

My fiancee did say that the certificate (police check) she got from the federal police says she is single on it if that helps. Otherwise, we have never been asked for a document like what you described.

It is easier to travel to Brazil. I think you can get citizenship there in about a year too. Have you never been? I don't know what Ecuador has to do with this...

And, you can actually only stay legally 90 days in 1 year which can be extended to 180 days by the federal police.

Does anyone have any additional information about this? My fiance is in Brasil, never been married, but we have never heard of needing this for the interview. It is NOT listed as a required document on the consulate website, but I wouldn't be surprised if they have added something without updating the website. Thanks.
