Citizenship for my son possible before AOS?

Timeline

I'm wondering if my 5 year old son who's father is a US Citizen can obtain citizenship before we do AOS after my boyfriend and I are getting married next year...

The "problem" is that even though my son's biological father is on my boy's birth certificate,he refuses to sign any papers.

A German Court has ordered him to pay Child Support and proved that he is the father of my son.Yet as far as I can tel,the German Court Papers aren't worth the paper they're on.

He does not pay Child Support,nor has he signed anything(except for receiving the papers and since he never filed anything against the German Court Orders he accepted them).

Can my son obtain the US Citizenship or not?

I know he could if his biological father would sign the papers,but he doesn't and wont do so in the future since if he would he would agree to pay Child Support.

Are the German Court Papers valid in the US? There has not been a DNA or Paternity test since the biological father agreed to the Court Orders when he didn't do anything against them.(He was given 3 months to do so but never did say that he's not the father and also didn't reject the paperwork that was sent to him).

I will go through the Texas General Attorney to finally get him to pay Child Support once we are in the US and have settled in,but I would like to know whether my son has to do all the AOS stuff r not.

Came to the US for good on Jan 27th,2009

and we got married on March 28th,2009
