Timeline

Hi everyone. I am new here, just thought I could get some help from people in the same situation. I am engaged to a sailor in the US Navy. He is in Virginia, I am in Canada. We met last summer and got engaged Nov. 29. I am a bit scared about this whole thing because when we came to Canada, we were going to get my stuff and return to the US but the Canadian side told us to go to the US border side to see if they still had my Alien number on file(I lived in the US for 14 years but was told to submit my green card the year before because it was outdated). I was told by a Customs official, after he threatened to throw me in jail and accused me of lying, that my only legal way to go about this is the K1 Visa. Now we have sent in our paperwork and we're waiting. The Vermont Service Center sent my fiance the new form last week so they can update our file. I am just scared that when I go for the interview, they might ask about the border thing or if I was ever denied access to the US. What do I say if they ask? Thanks for anyone who might be able to help and if anyone has any advice on this K1 Visa stuff. (L)

Well for one thing don't lie about what happened - its possible they have a record of it - so lying would be a definite bad move.

They may not ask of course at interview - but I *think* there might be something about 'have you ever been denied access to the US' (or something along those lines) on the packet 3 forms.

Be honest - you made an honest mistake - you believed one thing (that having been a resident before you could just go back) but found out from the POE person that this was not the case, he gave you a recommended course of action to take (apply for K1) and you took it. You weren't arrested and you weren't intending to defraud anyone.

Always be upfront and honest in your dealings with the government / immigration - and try not to panic - many people have been turned back at POE and gone on to make a successful K1 application :)

Dec 20th - Forms recev'd at CSC

Dec 27th - NOA1 received by snail mail!

Dec 29th - 'Touched'

March 10 2006 - NOA2!

March 23 - recv'd at NVC

March 24 - petition sent to London

April 9th - Pkt 3 rec'd!

May 17th - Pkt 3 signed for at London Embassy

May 24th - Medical

May24th - Pkt 4

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Aug 9th - SSN received

Honesty is always the best policy when it comes to this whole process ...

It sounds like you will be going through Vancouver consulate and Vancouver asked my if I had ever been denied entry into the US (which I haven't so I can't give you any personal experience) ... I think you even have your right hand up and are swearing everything is true and to the best of your knowledge ... Also on one of the forms you fill out it also asks you the same question ...

Just answer honestly and correctly and write a brief description of what happened when you tried to enter the US and bring it to your interview ... I am sure you won't have a problem if your entry denial was as simple as you stated ...

Did you say in your post that you overstayed on your original greencard? That you did not renew it? Your reference to it 'expiring' is throwing me.

If you did, then you have a bigger problem than just having been turned back once.

If not, then just do as the others said and tell the truth.
