We have also filed for AOS (from VWP) in April. We received the NOAs on 11th April so waiting for the biometrics appointment now.

Haven't posted on this forum before but have been reading it for a while and have found it extremely helpful so far with the process.

Hello everybody! I just sent my AOS today so thats make me an April 2009 filler! I hope I'll get my NOA1 fast cuz my I94 expired on the 23rd but we couldn't send our paperwork earlier because of the money...This immigration process is expensive!! But worth!!! So, good luck to all of us and lets keep in touch!!

Welcome Giuly and Rocky! It takes about a week for the checks to be cashed and you should receive NOA'S a few days later.

I have exciting news! We received our NOA's for I-130, I-131, I-765, and I-485. All dated April 13th. We must have very slow mail!

Thanks Shelly, I'm from London. I have an update already - I received my biometrics appointment letter today - it is scheduled for Monday May 11th at 8am!

I believed that the poverty Guide line requires 18k+ for the household of 2. ..... I was thinking of using my brothers income since we are all living in the same household. My brother makes 30K+ a year but no assets either :( ........What should i do?

Can we both skip the ASSET part ? and just provide our Income tax return and employment letter? Please help. Thank you!

Maybe I'm wrong but I tought assents part was optional for people that didn't meet the poverty line requirement...

If your income, or the total income for you and your household, from line 24c exceeds theFederal Poverty Guidelines for your household size, YOU ARE NOT REQUIRED tocomplete this Part. Skip to Part 8.

So u need to check the poverty line guide again and see if u are above it.

I know we did not complete this part! ANyways, anybody else have suggestions on this?

Yahyah do you have a savings account or checking account? Anything in those would count as assets. And if you meet the poverty requirement you do not need to fill out assets.

Hi Yahyah,

First thing to do is check the I-864P for 2009 - Poverty Guidelines.

For 2 people the 125% amount is: $ 18,212.00

Therefore you make over the 125% of the Poverty Guidelines that is required.

It should be fine, however if you would feel more comfortable having your Brother act as a co-sponsor, you should fill out the I-864 and have him fill out the I-864A. The I-864A is for household members and as you live with your Brother this would apply.

Both of you can skip the asset part - just enter N/A (does not apply).

You are required to provide the latest year tax return (2008), you should probably include 3 years for yourself (only because your income is right on the cut-off). An employment letter is optional, but if it is easy to get you may as well provide that as well. Also for yourself you may want to provide your last 3-4 payslips (again, because your income is near the guidelines mark).

I would include a letter from your work on official letter head that includes your start date. Immigration lawyers told us to include employment letters even though we met the poverty line. The payslips probably are a good idea too.
