J-1 visa and DS-230

if you have ever been in the states on a J-1 visa (which usually have the 2-year residency requirement), send the photocopy of your old DS-2019 (that goes with J-1 visa) along with your DS-230...

Dated since 2004, 10/22/2008 Married in NY, wife left the country, returns on 01/06/2009 as a visitor (granted stay until July 2009)

01/15/2009 Sent I-130 package for CR1 to Chicago Lock Box, 01/19/2009 USCIS Chicago received the application

01/26/2009 USCIS sent out NOA1, 01/28/2009 Moneygrams Order cashed

02/24/2009 Case is in Vermont Processing Center (told by the USCIS by calling the free phone line)

03/02/2009 NOA2 mailed, application approved!!!! (47 days since we mailed I-130 package)

03/05/2009 NVC Received Case / Case number assigned

03/12/2009 DS-3032 / AOS fee bill generated and e-mailed to us, 03/12/2009 I e-mailed and snail mailed DS-3032 and paid AOS fee bill online

03/18/2009 NVC received DS-3032 and it was entered into the system (I never received email confirmation)

03/20/2009 IV Bill generated and I paid online

03/30/2009 Sent I-864 package to NVC, 03/31/2009 Sent DS-230 package to NVC

04/01/2009 IV fee shows unpaid, 04/03/2009 documents are under review (confirmed by operator)

04/06/2009 IV Fee finally shows PAID, 04/07/2009 AVR system says that IV bill has been processed, "instruction package" received by email

04/08/2009 AVR system says "NVC received your documents on April 3...", our case is under review...

04/10/2009 RFE issued for DS-230 Part I, but AOS accepted

04/14/2009 found out the exact issue with DS-230 and sent the response using Chris Parker's RFE shortcut and later in the day received an email checklist for RFE

04/15/2009 RFE response arrived to the NVC facility, 04/20/2009 RFE response received by NVC

04/23/2009 CASE COMPLETED, 06/02/2009 VISA RECEIVED

hi...yes, absolutely send in the photocopy of your j-1 visa (there should be a statement about the 2-year residency requirement)...also, mention what this program was about, whether you were an au pair, a scholar, etc. whether the program was funded by you or the us governement, etc. they asked me for all that.

i don't have the 2-year residency requirement either, but they don't know that and this is why i received RFE and still waiting for my case to be complete just because of that.

i was so angry because there was no mention of any kind of information needed in regard to j-1 visas in the whole DS-230 instruction package.

my husband was on a J-1 twice but doesn't have any of the visas anymore. they were in an expired passport and you have to hand those back. what if you don't have any of those? this was a long time ago.... never heard of any of this. i can't believe we are going to get another RFE.

3/19/2009 IR-1 case number/AOS Bill received; DS 3032 received

3/20/09 mailed in DS 3032; 3/21/09 paid AOS bill

3/25/09 AOS bill reads PAID

3/26/09 retracted K-3 application at Paris Consulate

3/26/09 mailed I-864, e-mailed DS 3032

4/3/09 I-864 received, e-mailed DS 3032 again

4/9/09 AVR: I-864 reviewed, RFE; DS 3032 accepted by e-mail; paid IV bill

4/10/09 IV bill reads PAID; received checklist letter for I-864 RFE by e-mail; received IV Bill

4/14/09 DS 230 mailed

4/15/09 DS 3032 mail version accepted

4/21/09 I-864 checklist response mailed

4/22/09 I-864 checklist response received by NVC; NVC operator says mail arrived on 4/17/09 (should be DS230!)

4/23/09 sent DS-230 addendum to NVC by overnight mail and e-mail

4/27/09 AVR: tax transcript entered into system on 4/23

4/30/29 AVR: DS-230 entered into system 4/29

5/2/09 AVR: new RFE

5/4/09 NVC: false RFE due to DS-230; e-mail version of DS-230 J-1 info received - NVC e-mail response

5/6/09 AVR: new RFE ! (passport photos???? and canadian police certificate that is not required???)

5/7/09 NVC operator: canadian police certificate not needed, file will be pulled to look for passport photos (15 bus. days)

5/14/09 AVR: checklist letter response received on 5/13; 5/16/09 AVR: checklist letter response received on 5/15

5/19/09 login to NVC site failed!

5/20/09 CASE COMPLETE!!!!

exactly, he might not get anything but i would recommend with DS-230 Part 1, where you have to list all the visas you previously held, he should state next to j-1 what kind of program it was, who funded it, which organization it was with, etc.

i contacted my embassy that i am going to have the interview at and they told me that their records show the same thing that my visa is showing but they don't keep any of the forms, of course.

unfortunately it's too late. we mailed it earlier this week. oh well...

as long as they have the actual visa record then i won't worry about that too much. i wouldn't even know how to get records of a visa from years ago!

will just have to hope for no RFE.
