I have to give an explanation why I have not filed income for the last 3 years...

What is acceptable for the embassy as an explanation...

I have this so far ... I am not required by law to file tax returns, because my gross income was below the IRS filing requirement.

What else should I state?

nothing else you have to put, my mother in-law never did income tax- so I wrote a letter for her and I just put she never work, is a house wife and her husband and kids support her, but you have to have someone who can do the affidavits of support for you husband, you know that right? because I did it for my brother in law because my mother in law was the petitioner but never did income tax. Inshallah this help you

beside the joint sponsor remember to file your own affidavits of support plus the letter, maybe you already know that, but just in case

Just give the circumstance (student, homemaker, missionary, etc.) in your explination. No one can dispute the truth.

I would also include proof that you did not need to file, Page 3 of the "Tax guide for US citizens and resident aliens abroad" shows this chart. You can always just print that out and highlight that section as proof and add it to the I864:)
