Hello everyone,

I am wondering if anybody has any accurate information about if a co-sponsor can be removed from their liability of sponsorship at their request later down the road if they are to be replaced by someone else, in this case my fiancee.

The reason I ask is that my fiancee lost her job due to the economy and corporate layoffs and hasn't found a new job yet. I have my interview with the US Consulate General at the end of April and the old I-134 notarized form that we had from her previous job is no longer applicable. Her mother is hesitant to co-sponsor me at the moment because she doesn't understand all that is required and I'm trying to collect all the information needed so she can make an informed decision.

Basically, I just want to know if its possible for someone to temporarily co-sponsor someone so that once my fiancee finds a job, we could just remove the mother's name from the sponsorship list and absolve her liability.

Any ideas?

I greatly appreciate any feedback.

Right now it seems like you just need her to co-sponsor for the visa. Once you get the visa and are married you file your AOS at which time you have to fill out new support documents and you don't have to use the co-sponsor if you don't need to.

If you are doing K1 dagnytaggart is correct. The I-134 sponsor is only for the K1 period. At AOS the I-864 is filed. That is the real commitment. The USC petitioner is always the primary sponsor. If the petitioner cannot meet the income requirements then a joint sponsor will be needed. That person will remain committed for the full term ( that term may be 40 quarters of employment unless the beneficary becomes a USC or abandons their LPR status). You cannot withdraw your affidavit.

The best source of information for her mother are the form instructions themselves.

Right now it seems like you just need her to co-sponsor for the visa. Once you get the visa and are married you file your AOS at which time you have to fill out new support documents and you don't have to use the co-sponsor if you don't need to.

I never thought of that, that's amazing. It gives us another 1.5 months or so for her to find a job. Wedding is on June 6th so its coming fast.

All and none. Yes and no. No extra paerwork required.

The I-134 is valid only until replaced by the I-864 when you adjust status so it is "temporary" anyway.

By the time you adjust status, you may have the problem solved. Your fiancee (spouse)however, will not "find a job" prior to adjusting status as he will not be eligible to work. At the time of filing the AOS he will not have a documentable job. The I-864 is the long term commitent, however your mother's risk is small unless your spouse goes on welfare, or she plans to file for a K-1 herself and doesn't need the extra "dependent" on her forms.

I a not aware of a way to officialy remove a co-sponsor, but maybe someone else here knows of such a thing
