an ID while waiting for GC

Hi!

I got a question.

What kind of a valid ID with a picture can i get while waiting for my GC?

I've got my driver's permit, but it expired a few months ago.

So long, nobody has had any issues with my ID, but on the last saturday i was refused to receive a casino ID, because my driver's permit was expired and i didn't have anything else to show.

Could i get a state ID, or maybe there is something for people like me- in the process of getting a GC?

hey privetic..

Before i got my driving permit, i went and got my State id, i had to bring, my NOA for the AOS and I-94,Passport, my birth certificate translated, our marriage certificate ,social security card and everything what i could show... and they issued me a State id same day...thats all..They had no reason not to give me one

hey privetic..

Before i got my driving permit, i went and got my State id, i had to bring, my NOA for the AOS and I-94,Passport, my birth certificate translated, our marriage certificate ,social security card and everything what i could show... and they issued me a State id same day...thats all..They had no reason not to give me one

Depends on the state you have been living in. Every state has got different rules.

If you have an EAD, no problem, you can get DL too for example.

it really depends on the states..some respect NOA some want to see a visa wich is not expired..in texas i got the DL with my EAD not earlier and then it was a temporary ID wich was valid only for the time like the EAD ...after i got my GC i went to the DMV and got the regular ID

so my advise..call ur DMV and ask there wich papers they need

Just called DMV.

No state ID will be issued as long as the GC will not be approved.

Assuming you're in MO, they fibbed to you (or at the very least weren't exactly clear)

Have a read of this document: http://dor.mo.gov/mvdl/drivers/idrequirements.pdf

The very top of page 4 is what you're looking for - says clearly that AOS applicants are eligible for drivers licenses and state IDs provided they have "Immigration documentation indicating status, and one of the following: Employment Authorization Document or Passport"

Reading that, you should be able to get a DL with you AOS NOA1 and unexpired foreign passport.

The problem is you can't fight with the DMV stuff.

They didn't want to extend my permit last fall and i don't see how will they issue any kind of ID given the fact that nothing changed and i've got the same documents did 4 months ago.

Unless i could put this http://dor.mo.gov/mvdl/drivers/idrequirements.pdf on their table.

I wonder if that would help...

Absolutely print it out and take it to them.

It always pays to double check with the actual rules when the DMV tell you something. I had similar issue with the GA DMV - we were at the office to change my wife's name and I asked the guy what I would need to show to get my DL and the guy basically suggested I-94 with 6-months validity or green card or no DL would be issued. I thought that was fishy, checked myself and indeed he was completely wrong (although I did have to wait for my EAD and SSN).

When I eventually went to get my learner's permit with what I knew was valid documentation, he wanted to send me away again because he decreed that a (very recent) tax return wasn't proof of residency. I showed him the driver's manual where it states a current or prior year's tax return is is valid proof. He then went to ask his supervisor and promptly returned slightly red-faced and said "that will be fine, sir." Small victory :D

So if you think they're treating you wrongly, quote their own rules at them (with a copy of the state driver's manual, preferably - documentation requirements should be in there). Failing that, insist on speaking to a supervisor and above all, never take their word for it without checking for yourself :)

[edit to add] Just read this thread though and maybe you're in a no-win situation at the moment because I wonder if technically your AOS isn't going to be 'pending' again until they re-open it?
