Okay, I am the U.S. Citizen sponsoring my wife's AoS. On the g-325 there is a checkbox area that says:

This form is in connection with another application for:

Status as a permanent resident.

Of course I checked the box for Lin (my wife), but do I check it off for my g-325 too?

Thanks again guys.

Ryan~

If you're talking about the form I-485 then yes you do not have to fill out form G-325a, however for the I-130 you should put something in the line of "in support of wife's I-130" on your G-325a

The time line indicates that this is an AOS from a K1 visa (and AOS application is overdue!!).

So, I-485.

Ah, thats's true if you are doing an I-130 as well...

I'm not sure what it is that makes you have to file the I-130 if you have already filed the I-129F?

My husband came on K-1 and we filed AOS before the I-94 expired so as far as I know we did not need to file an I-130 in conjunction with the AOS paperwork.

If you ARE NOT filing the I-130, then only the immigrant does the G-325A

NO. You are adjusting from a K-1 visa. You do not need to submit an I-130 OR a G-325a for yourself. The exact time of her arrival isn't important. Your "timeline" indicates you received a K-1 visa and that is the determining factor.

Good luck

The 'determining factor' is not the visa type the alien entered on.

The 'determining factor' is the aliens status at the time the marriage occurred.
