Good morning my fellow VJ family,

Here is our story and I hope that someone can give us some well appreciated guidance. My wife is from Vietnam. She came to the US on a Fiancee Visa and we have married. We most recently filed for Removal of Conditions and is on her 1 year extension. She has a son who is 8 years old from her previous marriage in Vietnam. We included him on our original petition to bring my fiancee here. We did not think that her ex was going to cause any problems since he rarely spent any time with him. Well, out of ignorance, he refused to sign the required document to release my wife's son to come live here. I am not sure exactly what this paper is called, but I was told he had to sign this paper or her son could not leave the country. Well, hopefully some good news hopefully. Her son continues to ask her ex when he can come live with mom, and he said at the end of this school year. We are excited, but holding back the excitement until he agrees and signs this paper.

So my questions are:

What is the correct name for the document her ex needs to sign?

Where can I find this paper?

Or does he have to obtain it in Vietnam?

What else do we need to do in filing for her son???

Removal of Conditions Timeline:

03-05-09 - I-751 sent

03-09-09 - NOA1 (1 yr Extension)

04-08-09 - Biometrics

07-09-09 - Card Production Ordered Email

07-17-09 - Green Card In Hand

I-130 Filing for Step-Son

11-30-09 - Received at USCIS

12-04-09 - NOA1

03-01-10 - NOA2

03-05-10 - NVC Case # Assigned

03-09-10 - NVC Mailed DS-3032 and AOS Bill

03-12-10 - Emailed DS-3032 to NVC

03-13-10 - Received Email from NVC stating they received DS-3032 (Also received AOS Fee Bill and DS-3032 in the mail)

03-14-10 - Paid Affidavit of Support Fee and IV Bill online

03-16-10 - NVC Website updated to PAID for both fee's

03-17-10 - Petitioner and Agent received emails to further proceed with case

08-05-10 - NVC Case Completed

10-27-10 - Interview PASSED

10-28-10 - Picked up Visa

normal process is 5 mos to a year, so you had better get moving

in most consulate the paper has no "name". it is a notarized parental consent to the relocation.... Best if done in Vietnam... my wife had a lawyer draw hers up for our son

In Colombia there is a sheet signed ( by the other parent ) and given to be notorized in Bogota allowing the child to leave the country without one of the parents. On the NVC side we had to provide a notorized letter allowing the children to immigrate to the US. Countries have differnt requirements and my suggestion is read read and read to find out what you need. However get the ball rolling and start the I-130 process as there is no longer the option of follow to join.

9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png
