Fact remains, that barbarian, the ENGLISH word means not simply foreigner (we have a word for that, look, I just used it) or alien, but also culturally, educationally, and in every way inferior to the culture to which the person employing the word belongs. Xenophobic was used to mean, surprisingly, what it is understood to mean, in fact, what it does mean until you decided, in your xenophobic way to try to make a badly thought out point.

that was confusing, but i'll try to answer.

the crux of the problem is in the current definition, which includes the concept of irrationality and fear. if you go back to my discussion of the family/tribe identity and it's relationship to personal security, then you will see that an aversion to foreigners is not irrational in the least.

again, you are being used by the people who have placed the term xenophobia in common use. think about it.

It's in the 14th amendment to the US Constitution.

"Amendment 14 - Citizenship Rights. Ratified 7/9/1868. Note History 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Well, it took quite a while, and several contradictory court verdicts before it was determined that the 14th amendment gave children born of illegals birthright citizenship. The original intent of the amendment, notable by its timing, was to make it clear that freed BLACK SLAVES became lawful citizens. There were several court cases, most notably the 'Slaughter-House cases' [83 US 36 (1873)] and in [112 US 94 (1884)], that further distinquished the limits of birthright citizenship, providing that the citizenship of the parent defined the citizenship of the child. Elk v.Wilkins sustained the denial of US citizenship to American Indians, once again upholding the distinction between those who were subject to foreign governments, although born in the United States. American Indians, who were subject to tribal jurisdictions, were not granted US citizenship until 1924.

Courts are to use documentation developed during the formulation of the legislation to interpret the intent of the legislators when determining how to apply the law. The history behind the development of the 14th amendment leaves no doubt that birthright US citizenship was not to be granted to the children of foreign subjects just because they were born in the US. It is the inaction of Congress, which has the authority to enforce the original intent of the amendment, and limit citizenship to the offspring of US citizens, that has created the morass. That we do nothing allows them to do nothing.
