Need clarity on income requirements

I haven't been able to find any threads that discuss the income requirements in detail.

I'm confused about what they will 'really' expect for the applicant to have.

The general information has been the '125%' poverty line requirements, but what does that mean?

Do I need to have that much in current savings and or assets?

If I don't have any sizable savings, would my bi-monthly pay checks be enough as long as the amount is adding up to eventually meet the yearly total reuiements?

What if my past employement was in a foreign country, so my income was not US based? (I filed US tax returns every year)

Basically I want to know if I don't have savings, property or other assets and my prior 5 years tax returns don't meet the income requirements BUT my current job of 3 months is paying me a salary that exceeds the 125% poverty line requirements, would this satisfy the Affidavit of Support requirements?

10/07/2003 - Met online (talked everyday)

03/06/2004 - Flew to Russia for first in person meeting

03/10/2004 - Left Russia even more in love

08/30/2004 - We went to China to live together for 5 years

10/08/2004 - Engaged in Changchun, Jilin

04/24/2009 - Married in Beijing

05/07/2009 - DCF in Bejing

05/18/2009 - I-130 approved (NOA2)

05/26/2009 - USCIS in Beijing sent file to GUZ

06/26/2009 - P3 from GUZ arrived by EMS with case number!

07/01/2009 - P3 DS230 & OF169 EMS to GUZ

07/02/2009 - P3 delivered to GUZ by EMS signed for by 白天鹅宾馆

07/10/2009 - DOS confirmed that GUZ received P3 in system

07/20/2009 - DOS told me our interview date

08/18/2009 - Interview in GUZ at 7:15am

Hi it is 25 percent above poverty level from what I understand I just ask the same questions, and in my searches here on the site I found the number that it would be about 18000. a year that a person needs. or you need a co sponsor

Thanks Steve, but I am still wondering if the followinf scenerio is ok:

- My past 5 years income is foreign income earned outside of the US.

- I filed US tax returns every year

- I don't have W2's for the past 5 years

- I will return to America in May an secure employment

- I expect to have a salary that is above the 125% requirements

- I don't have a savings, property or other assets

- I expect to submit the I-130 as soon as I return to America in May

Given the above situation, when I submit my I-130, would one or two months on a new US job be sufficient?

Given the above situation, when I submit my I-130, would one or two months on a new US job be sufficient?

You don't submit financial information with the petition. That's done later after the petition is approved but before the interview. If you do have a new job earning well over the 125%, chances are that's going to be enough when the time comes but you would be wise to have a joint sponsor in your back pocket anyway.

What they really expect is for you to demostrate your fiancee will not become a public charge, or is not likely to. You can do this any ways. Having a current income above the guidelines is one. Having assets (including money in the bank) of three times the needed "income" is another. You do not NEED to have any money in the bank, and you do not NEED to have a job. But you need to show something as a legitimate means of support. Current income is generally far more influential than past earnings.

You are not required by law to keep income tax returns past three years. My practice is never to keep them 3 years and a day. You need only 1 year tax return (2008) at Moscow. If your current income is verified with an employment letter and check stubs it would be a pretty safe bet it will be acceptable. You can always line a co-sponsor just in case. If your income is sufficient, leave any other asset information blank
