Would I qualify for expedite processing?

Hello,

Just wanted to run a thought by you guys. I have been waiting for a long time to reunite with my fiancee. I was not able to apply for the K-1 for a while because I was not a citizen until April of this year. However I should have been a citizen back in August but USCIS misplaced my file, actually sent it to storage after my interview. I was aproved on the 4th of August 2008 and I was not able to set the Oath ceremony date until April of 2009. I had to make a lot of calls, write a lot of letters, go to a lot of infopass appointments and even get my Senator involved. If they would not have lost my file my fiancee would be here already and we would be married.

Now, on the USCIS website it stipulates that one would qualify for expedite processing due to USCIS error. My question is this: would I qualify to request this expedite processing? I realize that their error was with another case.

K-1 Visa

04/09/09 : I-129F Sent to Vermont

04/10/09 : I-129F Received by USCIS

04/14/09 : NOA1

08/19/09 : NOA2

08/24/09 : NVC Received

08/25/09 : NVC Left

08/27/09 : Consulate received

08/28/09 : Packet 3

08/31/09 : Packet 3 sent

09/16/09 : Interview - Approved

09/21/09 : Trip to Dallas

As much as that situation sucks, I don't see how it could warrant an expedite. You could always try the worse they will say is no but when they expedite due to USCIS error its usually because you have to refile for the visa (example: they lost your fiancees file and now you have to refile). I've been wrong before though lol.

I-751 file: 11/07/11

NOA1 date: 11/10/11

Biometrics: 11/30/11

Approval: 08/17/12

Hold what you got and maintain.

I think the USCIS error as a reason to expedite has to due with the filed petition. As in there is an error with your I-130. An error with a previous application I do not think applies.

April 15, 2014 APPROVED. Wait for oath ceremony

September 29, 2015 - sent letter to senator.

October 16, 2015 - US Citizen
