Hello,

I sent form I-752 to remove the conditions on my permanent residence on 03/15/09, 90 days before expiring. About 3 weeks later I received a notification to get the biometrics on 04/22/09 but I never received the NOA letter! I'm afraid my green card will expire and I don't have the extension letter yet, what should I do???

Go do the biometrics.

Contact USCIS on the status of your case.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi,

Since you have not recieved your NOA (Notice of Action), you are eligible for stamp of I-551 (temporary GC valid for 1 Year from date your GC expires). Please make an infopass appointment. http://infopass.uscis.gov/

Tell the IO (Immigration Officer) that you didn't get NOA but you did get biometric letter and you need a stamp on your passport. They should give you a stamp on your passport.

BTW use the number on your biometric to look up your case online.

Also you can do an early biometric without any problems, perhaps on the weekend.

Check your ASC (Application Support Center) mentioned in your biometric letter here.

If the case number doesn't work for you try to use it again 2 days after you have done your biometric appointment.

You do not lose LPR status, unless USCIS denies the I-751, the 2 year card can expire but your LPR status does not.

If you have not received the NOA1 letter by the time of expiration, then schedule an info pass appointment and find out what the problem is and simply request an I-551 stamp in passport.

Thanks everyone, I'll wait to have my biometrics done next week and then try to have my passport stamped. I need to prove that my green card is valid for another year to keep working in the US.

If you have a SSN card with the "With DHS Auth" notation, simply go to the SSA office and apply for one that does NOT have that notation on it using your STILL valid Green-card.

The if you look closely at form I-9 that employers use to note what they used for verify employment eligibility it clearly states that if you have a SSN card without the notation and you have ID like a driver's license than that is all you need to prove you can work.

Note List "C" on the I-9 used by employers to note they confirmed evidence of enjoyability.

I-9 indicates that can use evidence in column "A" OR ("B" AND "C"). "C" shows unrestricted SSN card can be used with something in Column "B" (DL, or other photo ID like student ID. The unrestricted SSN card is used to show employment auth.

I believe the employer still needs to confirm status with USCIS, but in the case of an unrestricted SSN they do not need to look for EAD or Green-card. http://www.uscis.gov/files/form/i-9.pdf

Do an Infopass and see if they can put a service request for a copy of NOA1. They would not give me any stamp until my GC expired and they made it clear Chicago gives only 60-days stamp.

Yesterday we received both NOA1s - even though I clearly filled the send to c/o section and had them send everything to my work address (so my firm's name is there), someone did not include it on NOA1 and the building management returned it --they're certainly not going to look for a first name initial and a very common last name among over 2500 employees in five companies!
