My wife is presently waiting on her AOS from Tourist to LPR (married and filed for AOS in Feb). We live in NJ. At what point can she get a driving permit and start taking lessons? I'm not sure what that depends on - I have been assuming she had to wait for her GC but maybe I'm wrong about that.

Depends on the laws of your state - check there for what she needs!

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I checked with New Jersey DMV over the phone. The agent told me that she has to have her Green Card in hand before she can even get a permit. The DMV website doesn't state it one way or the other but I've been misinformed by call center agents before.

Can anyone please confirm what the deal is in NJ?

Most states require 2 things, SSN and evidence of legal status (Valid I-94, EAD card or Green-card) NY specifies that the I-94 needs to be valid for 1 year or longer.

Again driving privileges are granted by the state, so the requirements vary by state.
