I'm America, she's Russian and we want to marry in China

I am an American living in Beijing on a Z visa (work). I have been here in China almost five years.

My fiancee' and I are planning to get married here in Beijing in April or May.

My fiancee' of five years is Russian.

My questions are:

1) Can I apply for the I-130 (k3 visa) for her here in Beijing? (we will be married in Beijing)

2) I plan to go back to America (Wisconsin) in June, so can I begin the process in China and finish it in America?

3) What is the current wait time for doing it in China versus America?

I am trying to determine if it is easier and quicker to:

1) get married first in Beijing and then file the I-130 (K3 spouse)

or

2) Do not get married in China, go back to America in June and file a I-129F(K1 fiancee visa).

Also, she has never been to the US (although she speaks perfect English), She has never tried to come to America and she doesn't have any kind of criminal records. Both of us are here in Beijing working with valid work permits.

*** Although I file my US taxes every year, my income the past five years has been paid to me in cash (RMB) by my Chinese employer. None of my income has been US earned income.

*** China does not do 'Direct Consular filing'

Time Line:

10/07/2003 - Met online (talked everyday)

03/06/2004 - Flew to Russia for first in person meeting

03/10/2004 - Left Russia even more in love

08/30/2004 - We went to China to live together for 5 years

10/08/2004 - Engaged in Changchun, Jilin

04/24/2009 - Married in Beijing

05/07/2009 - DCF in Bejing

05/18/2009 - I-130 approved (NOA2)

05/26/2009 - USCIS in Beijing sent file to GUZ

06/26/2009 - P3 from GUZ arrived by EMS with case number!

07/01/2009 - P3 DS230 & OF169 EMS to GUZ

07/02/2009 - P3 delivered to GUZ by EMS signed for by 白天鹅宾馆

07/10/2009 - DOS confirmed that GUZ received P3 in system

07/20/2009 - DOS told me our interview date

08/18/2009 - Interview in GUZ at 7:15am

Timeline

Unless either of you have residency in China, you will not be able to marry in China. I would suggest you marry in Hong Kong. My husband and I got married in Hong Kong because he was in China on a work visa as well and did not have residency papers in China. Hong Kong was alot easier and quicker. We filed first on a K1 and was denied because China said they weren't used to foreigners filing. So we married in Hong Kong and filed K3. It only takes a month at the most from the time the paperwork goes from the NVC center to the consulate till an interview, compared to China that took about 6 months.

CSC received May 1, 09

NOA1 May 6, 2009 (received in mail on 5-8)

Sent I29 May 9th, Received May 11th

NOA1 for I129 May 18th, 09

Received in mail on May 26th

I-130 Touch 8/14/2009, approved 9/1/09, 1129 touched 9-1,2,3, approved the 1st.

NOA2 for I-129 not received

Hong Kong Embassy received it on Sept 14th, 09

Packet 3 mailed out on Sept 22,09

I130 at NVC now

Received email Sep 23 about electronic processing for CR1

Packet 3 mailed on Sep 22, received on October 5th

Mailed packet 3 back 10-9 to Hong Kong, awaiting packet 4

Packet 4 mailed 10-15, Interview set for Nov 10th

In AP a little over a month

Got approval notice Dec 17th

Dropped passport off on 12-21

Received visa 12/24.

Flew to St Louis 12/29, now home.

China does do Direct Consular Filing. Check first with the Chinese authorities about whether two foreigners can legally marry in China. I doubt they can.

Facts are cheap...knowing how to use them is precious...
